Suspect In Child's Pregnancy Back In Court

MACOMB COUNTY (WWJ) - A Macomb County man is back in court on charges of sexually assaulting and impregnating his girlfriend's 11-year-old daughter.

A preliminary exam will determine if evidence is sufficient enough for a trial for 28-year-old Trevaun Cortez Brooks. His lawyer, Chris Aiello, said Brooks should be assumed innocent until proven guilty.

"We're waiting to get all the evidence in the case to make some determinations and obviously, you know, we don't have the burden of proof. The prosecutor has to prove that my client could have or might have broken the laws of the State of Michigan and that he's the one who did it, that's the probable cause hearing," Aiello said.

Brooks worked briefly at the Mount Clemens charter school where the girl attended class. Police say he also lived with the girl and her mother. It's not clear how long he knew the victim's mother or how long they lived in together in her Mount Clemens home.

After failing to meet with investigators, sheriff's deputies tracked Brooks down at the home of a new girlfriend in Warren over the Labor Day weekend. The now 12-year-old girl and the baby are in the care of the state services.

An earlier hearing to determine if there was enough evidence to warrant a trial was postponed. Details here.
