Hamlin Pub Softball Tournament OFFICIAL RULES

 

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.  VOID WHERE PROHIBITED.

1.  HOW TO ENTER

  1. The qualifying rounds of the Hamlin Pub Softball Tournament (the "Tournament") will begin on April 21, 2011 at 8:00pm E.T and end on Thursday, May 12, 2011 at approximately 10:00pm ET.  The Tournament will be held on May 14, 2011 (at a time and location to TBD).

 

  1. To participate in the Tournament, visit one or more of the selected Hamlin Pub Appearances ("Appearance(s)") at the dates and times listed.  At each Appearance, one (1) contestant from each team will have the opportunity to compete and attempt entry into the Tournament.

  1. Contestants may enter their softball team ("Team"), each of which may have no fewer than nine (9) players, once per Appearance, and registration forms must be completed before participating.  One (1) designated member from each Team will have the opportunity to play "The Bigs" on the Nintendo Wii, in a "home run derby contest" at each Appearance.  The Team, whose designated member scores the most home runs in the video game on each particular game day, will be qualified to play at the Tournament on May 14, 2011 (time and location TBD).  If there is a tie between qualifying Teams, additional video game rounds between the tied Teams will be conducted until a winner is chosen.  A total of seven (7) qualifying Teams will be selected at the Appearances:  one (1) at each of the first three (3) Appearances and two (2) qualifying teams from the last two (2) Appearances.  Individual contestants as well as their Teams may only qualify to play in the Tournament once.  Contestants will each be required to sign a participation waiver in order to participate in Tournament.

 

  1. A total of eight (8) qualifying Teams (one (1) Team being a 97.1 The Ticket staff team) will have an opportunity to compete in the Tournament.

 

2.  ELIGIBILITY RESTRICTIONS

  1. The Contest is open to all legal residents of the state of Michigan who possess a valid government-issued picture ID, and are 21 years of age or older at the time of entry.  Employees of the Hamlin Pub ,the participating CBS Radio stations, WOMC-FM, WVMV-FM, WWJ-AM, WXYT-AM, WXYT-FM and WYCD-FM (collectively, the "Stations"), the Stations' licensees, and their respective licensees' parent, subsidiary, and affiliated entities, the Stations' advertising and promotional agencies, participating sponsors, and employees of other radio stations in the Detroit metropolitan area and the members of their immediate families and/or households are not eligible to participate or win.

 

  1. Each Team may have no fewer than nine (9) players.  Winners must meet all eligibility requirements to receive any prize package.

 

  1. Contestants are required to provide truthful information.  The Stations will disqualify any entry from individuals who do not meet the eligibility requirement.

 

3.  PRIZE

a.   One (1) Grand Prize:  the Team captain of the winning Team will be awarded a Cruzin Cooler 50-Series scooter and two (2) Franks Red Hot Sweatshirts.  (The Team captain may provide any part of the prize to his or her teammates.)  The Cruzin Cooler 50-Series will be awarded as is.  The Approximate Retail Value of the Grand Prize is $649.00.

b.   All prizes or prize certificates may be picked up at the office of the Station at the address below.  The winner will forfeit any prize or prize certificate not claimed within forty-five (45) days of winning.  In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss.  The Station is not responsible for the safe arrival of a prize or prize certificate.

c.   There is no substitution, transfer or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes or cash of comparable value.  The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses.  Other restrictions may apply.

4.  SELECTION OF WINNERS

a.   Decisions of the Stations' management with respect to the Tournament are final.

  1. Each of the seven (7) qualifying Teams will be invited to participate in the Hamlin Pub Softball tournament held on May 14, 2011 (time and Date TBD).  There will be a total of 7 qualifying teams from the appearances at Hamlin Pub, and one (1) staff team from 97.1 The Ticket.

 

  1. During the Tournament, which will be conducted by Hamlin Pub, the Teams will be put into a random bracket with three (3) rounds.  (i) Round One will consist of two (2) Teams playing against each other, in four (4) qualify rounds.  The winning Teams from each bracket will then move into the semi-final rounds.  (ii) Round Two will then have two (2) games with the four (4) qualifying winning Teams.  The winning Teams from each of the qualifying games will then move into the final round.  And, (iii), the Final Round will have the two (2) finalist Teams, each vying for the grand prize.  Only one (1) Team will be selected as the Tournament winner.  (The 97.1 The Ticket softball team is not eligible to win the grand prize; if the 97.1 The Ticket softball team is the grand prize winner, the prize will then go to the second place team.)

 

  1. The Station reserves the right to not choose winners at an Appearance if no eligible contestants participate at the Appearance.

 

  1. Contestants must be present at the Appearance to win a qualifying entry.  Finalists must be present at the Finals to compete to win the Grand Prize.

 

  1. Prize winners must execute and return any required affidavit of eligibility and/or liability/publicity release at the Appearance or as otherwise directed by Station or prize will be forfeited and Stations may elect not to award the prize to an alternate winner.  Semi-Finalists will not be eligible to participate in the competition to be selected as the Finalist if the Semi-Finalist has not delivered the required affidavit and release prior to that portion of the Tournament.  If a potential Prize winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, potential winner forfeits prize.

 

5. CONDITIONS

  1. Payments of all federal, state and local taxes are solely the responsibility of the winner.  The winner will be required to complete and submit an IRS Form W-9 with the winner's full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station's market) in a calendar year with an aggregate value of $600 or more.  Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.  Such winnings of $600 or more will be reported to the IRS.

 

  1. By participating in the Tournament, the winner agrees to have the winner's name, voice and likeness used in any advertising or broadcasting material relating to the Tournament without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

 

  1. Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require the Tournament winner to sign a liability release, agreeing to release and hold harmless Hamlin Pub, the Station, its licensee, and each of their respective parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Tournament.

 

  1. If for any reason this Tournament cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Tournament, or if the Tournament is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate, suspend, or modify the Tournament.  If the Tournament is terminated before the original end date, the Station reserves the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.

 

  1. The Station, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station's website.  Failure to comply with the rules of the Tournament may result in a contestant's disqualification and/or forfeiture of any prize or prizes.  If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Tournament, the Station reserves the right to disqualify that entrant from entering and/or winning future Tournaments and to prosecute and seek damages to the fullest extent permitted by law.

 

  1. The Station reserves the right to make changes in the rules of the Tournament, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement.  If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Tournament and shall not be required to award a substitute prize.

 

  1. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Tournament or in the announcement of a prize.

 

  1. For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by May 13, 2011 to "Hamlin Pub softball Tournament – Official Rules," Attn:  Promotions, 31555 W. 14 Mile Road, Ste. 102, Farmington Hills, MI  48334.  For the names of the prize winners send a self-addressed stamped envelope for to the above address marked "Hamlin Pub softball Tournament – Winner List."  The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station
