Larimer County DA Says Police Shooting Justified

FORT COLLINS, Colo. (AP) — District Attorney Clifford Riedel has cleared a Fort Collins police officer involved in a shooting that left a man dead.

The district attorney said in a report issued Friday that officer Peter DeKraker was responding to a request for a welfare check Oct. 5 when he approached a man lying in the stairwell of a town house complex. Investigators say 27-year-old Tino Martinez pulled a gun and shot the officer and DeKraker fired back.

Both were taken to a hospital, where Martinez died.

DeKraker, who was wearing a bulletproof vest, has been released from the hospital and remains on paid administrative leave.
