Man Killed In Struggle With Police In North Austin

UPDATE:  11/24/10 8:24 a.m.

CHICAGO (CBS) - A man has died after being shot in a struggle with police in the North Austin neighborhood in the early morning hours.

The suspect was shot with a police officer's weapon but police News Affairs was not immediately able to clarify if the weapon discharged by accident or if police intentionally shot the man.

At 1:20 a.m. Wednesday, uniformed officers from the Mobile Strike Force Unit saw a van with several people inside in the 5200 block of West Kamerling Avenue. The people inside the van were throwing things out the window, police said.

The officers tried to pull the van over. At first, the van didn't stop, but later, several people got out, police said.

A Grand Central District police lieutenant said several of the people in the van "jumped out and charged at the officers.''

As the officers approached and announced they were the police, a male suspect lunged at an officer and attempted to take his gun, police said.  A struggle ensued, at which time the officer's weapon discharged, fatally striking the suspect, according to News Affairs.

The 22-year-old man was pronounced dead at Mount Sinai Hospital at 2:04 a.m., according to a Cook County Medical Examiner's office spokeswoman. His identity has not been released, pending family notification.

Two officers were transported to an area hospital with non-life-threatening injuries, police said.

A spokesman for the Independent Police Review Authority did respond to a request for comment.
