Gary Cop Rejects Plea Deal In Drug Trafficking Case
GARY, Ind. (STMW) -- Gary Patrolman Marla Guye rejected a plea deal that would have included little or no jail time, opting for a June 16 trial in Lincoln County, Okla.
If convicted of drug trafficking, Guye, 31, faces a sentence of four years to life in prison.
Guye and her boyfriend, Terrance Gee, 26, of Michigan City, were stopped on the Turner Turnpike near Chandler, Okla., in October 2012 by a member of the Oklahoma Highway Interdiction Unit after a trooper saw the couple's rental car shifting between toll lanes.
The trooper obtained permission to search the rental car the couple had rented after flying to Arizona the previous day. In the only suitcase, he found 48 pounds of marijuana.
"I've seen the video," Lincoln County Assistant District Attorney Pamela Hammers said. "I don't have any doubt she knew she was trafficking."
Guye was scheduled to change her plea twice this year, first in early January and again Tuesday. In her most recent court appearance, Guye chose to go to trial on the criminal matter. Gee, too, is set for trial in June. Both have a May 27 pretrial hearing, Hammers said.
The plea agreement would have allowed Guye to serve most of her sentence on probation. Oklahoma law does not allow probation on trafficking convictions, Hammers said.
Guye and two other officers were recently notified they are subjects of a new city ordinance that removes them from the payroll while their felony matters are pending. Guye and Patrolmen Jennifer Powell, charged with ghost payrolling, and Demonte Yanders, charged with battery, received notice earlier this year.
Gee has a May 5 court appearance in Lake County court on a traffic arrest in April 2012 by state police.
Guye was hired in November 2009, when then-Mayor Rudy Clay chose new police officers based on their Gary residency rather than how they fared on a battery of tests.
