Teen Charged as Adult in Football Player's Slaying

OAKLAND, Calif. (AP) _ A teenager has been charged as an adult in the fatal shooting of an Oakland high school football player, who was killed while celebrating his 18th birthday at his home.

Alameda County Chief Deputy District Attorney Tom Rogers said John Martinez was charged with murder on Tuesday in the drive-by shooting of Eric Toscano. Martinez was 17 years old when the shooting took place on March 27.

Police said Martinez, a suspected gang member, opened fire after he was turned away from Toscano's birthday party. Three other people were injured.

Police said they fatally shot one of two dogs Martinez sicced on them when they tried to arrest him on Friday.

Toscano played football at Skyline High School and had been accepted to California State University, Chico. Police said he was not in a gang.
