Woodland Mother Convicted In Baby's Death Asks For New Trial
WOODLAND (CBS13) – The defense of a Woodland mother convicted in the death of her baby has filed a motion for a new trial.
Samantha Green was in Yolo County Superior Court on Tuesday to be sentenced in the case of Baby Justice. She was convicted of second-degree murder in September for the three-week-old's death.
A hearing on the defense's motion for a new trial will be held on Dec. 9. If the motion is denied, then Green will instead be sentenced that day.
Baby Justice was found dead in a slough near Knights Landing in 2015. Green was later arrested for the infant's death.
Prosecutors said during the trial that Green took the infant into freezing water. Green's father Randy said following the guilty verdict that Samantha didn't mean to kill Baby Justice and should only have been convicted of involuntary manslaughter.
The district attorney has objected to the defense's motion, saying the issue was already raised during the original trial.
