VIDEO: Tony Molchak, Ohio man, accidentally shoots wife while confronting ex-wife's boyfriend, report says
(CBS) CHARDON, Ohio - A man confronting his ex-wife's boyfriend accidentally shot his current wife in an incident caught on camera, according to NBC affiliate WKYC.
The station reports the incident took place on August 25 when Tony Molchak was dropping off his daughter at his ex-wife's home in Chardon Township, Ohio. Molchak allegedly got into an argument with his ex-wife's boyfriend, Gary Schussler, while Molchak's current wife, Shelley Molchak, recorded the scuffle on her cell phone camera.
Schussler reportedly pulled out a gun after Molchak punched him in the face. Schussler then kicked Shelley Molchak and dropped his gun.
Tony Molchak is heard in the video saying, "I got the gun now!" right before a shot is fired.
The gunshot reportedly hit Shelley Molchak in the back. She was flown to a hospital with a collapsed lung.
The station reports Schussler's lawyer, Michael Peterson, says his client had the right to pull a gun on his property.
"He [Molchak] came to my client's property, and my client did what he had to do to protect himself," Peterson said.
Schussler was charged with assault against Shelley Molchak and with having a weapon while intoxicated. Tony Molchak was charged with negligent assault on his wife, according to the station.
