(Video) Miami teen says police restraint unprovoked, cops say it was necessary, according to report

(CBS) -- CBS Miami has obtained cell phone video of police officers apparently restraining a 14-year-old boy at a beach near Miami. The boy and his mother claim the forceful action was unprovoked and that one officer choked the boy and hurt a six-week-old puppy he was holding. Police reportedly say the boy resisted officers and gave them "dehumanizing stares," the station reports.

The video shows an officer holding his arm around the neck of 14-year-old Tremaine McMillian.

"I feel that should never have happened," McMillian told CBS Miami about the incident, which happened late Monday morning. "I don't like it. I feel sad. He got in front of me on the ATV and he slammed my hand. Then he started choking me. Then my 6-week old Pit Bull mix named Polo got hurt and bruised his front paw when the police grabbed me and slammed me down. It makes me feel sad."

Miami-Dade Police Detective Alvaro Zabaleta told the station that officers saw McMillan slamming another teen on the sand. Officers reportedly told him his behavior was "unacceptable." When McMillian wouldn't tell police where his parents were and started to leave, officers attempted to detain him, but he "had closed arms, clenched fists and pulled his arm away," police said, according to CBS Miami.

"Once he was approaching the road, the officers restrained him. Again his body language was that he was stiffening up and pulling away," det. Zabaleta reportedly said. "Now you're resisting officers at that point and when the hands are swinging and you are resisting officers, at that point you have to be taken into custody."

McMillian was reportedly charged with resisting arrest with violence, a felony, and disorderly conduct. He has pleaded not guilty.
