NEW YORK (CBS) He's a fixture on "Jersey Shore" and will soon compete on "Dancing with the Stars," but Mike "The Situation" Sorrentino will not be able to profit off his now-infamous nickname.

Sorrentino filed an application with the US Patent and Trademark Office earlier this year, hoping to trademark "The Situation" in order to market a line of T-shirts and underwear.

According to the New York Post, the 29-year-old's bid was rejected due to its likeness to a "Situation" trademark that was issued last year to a shoe and clothing retailer based in Memphis, Tenn.

The rejection comes a month after his "Jersey Shore" castmate, Nicole "Snooki" Polizzi, attempted to trademark her nickname.

Her request was also denied, due to its likeness to the registered title of the children's book "Adventures of Snooky," which is about a cat who falls overboard while fishing.
