According to the Washington State DUI arrest report, Langone, 21-years-old at the time, was pulled over and arrested in the early morning on May 16, 2010 in Kent, Wash., RadarOnline.com reports.

At the time of arrest Langone took two Breathalyzer tests; he blew a .098 in the first one and a .088 in the second, both above the legal limit, reports RadarOnline.com.

The arresting officer Christopher Storton said in his report he could "smell a strong obvious odor of intoxicants coming from the vehicle."

While Langone was being transported to the station the officer said he began singing, according to RadarOnline.com. Langone did not serve any time on the condition that he keep a clean record for the next two years and attend a drug information course, reports RadarOnline.com.

One year prior to his own DUI, Langone was the victim of a car crash involving a drunk driver. He brought up the accident in his American Idol audition. He walked away with two broken arms that now have metal plates and screws in them and a broken pelvis.
