(CBS/AP) NEW YORK - "Boardwalk Empire" star Paz de la Huerta spent her Tuesday in a Manhattan court where she was charged with assault for last month's scuffle at the Standard Hotel. De la Huerta got into trouble on March 20 when she allegedly punched and threw a glass at Samantha Swetra, the formerly reality star of MTV's "the City."

Swetra was with her pal Lindsay Lohan at the time of the fight.

Paz was charged with five misdemeanors, including attempted assault, fourth-degree criminal possession of a weapon, harassment and two counts of third-degree assault. She reportedly remained silent during the arraignment, and was released without bail.

De la Huerta derided Swetra saying, "I'm a real actress - HBO. She's a publicity-seeker, a fake actress," according to prosecutors.

"We're asking people not to rush to judgment and to let (de la Huerta) have her day in court," defense lawyer Jamel Oeser-Sweat said.

The actress plays Lucy Danziger, the girlfriend of Steve Buscemi's character, on the HBO series. The 26-year-old de la Heurta has also appeared in films including "The Cider House Rules," "A Walk to Remember" and "The Limits of Control."

She is due back in court on May 19, TMZ reports.
