N.J. police officer won't be charged in Atlanta exec's killing

(CBS/AP) NEWARK, N.J. - A New Jersey grand jury has declined to indict against a police officer who shot and killed a Georgia businessman in a Newark park last year, authorities said Tuesday.

The Essex County prosecutor's office said the grand jury did not find enough evidence to charge 30-year-old Edward Esposito in the death of Atlanta executive DeFarra Ivan Gaymon on July 16, 2010.

Detective Esposito was reportedly working undercover in Newark's Branch Brook Park at the time of the incident. Esposito says he saw Gaymon allegedly engaged in a public sex act, and that the executive appeared to panic and fought back when the officer tried to arrest him.

Prosecutors said a chase ensued, and that Esposito fired one shot after Gaymon allegedly threatened to kill the officer, reached in his pocket and lunged at him.

At the time of the shooting Gaymon's sister, Kelly Gaymon Armstrong, said she found it unbelievable her brother would fight an officer, reports the Atlantic Journal Constitution.

"There's nothing threatening about his character," she said. "It doesn't add up."

Gaymon, a married father of four, was the president and executive officer of the Atlanta City Employees Credit Union.
