(CBS/WCBS/AP) GARDEN CITY, N.Y. - A New York City teacher was accused of having sex with an underage student who attends the Queens high school where she taught.

Tara Driscoll reportedly surrendered Friday and pleaded not guilty to charges of third-degree rape and performing a criminal sexual act.

Police say the 33-year-old English teacher had sex with the student at a motel in Long Island last March. They say the victim, who is younger than 17, remained quiet until his mother found out and contacted authorities.

The prosecutor indicated they have photo and video evidence which suggests a pornographic video was being shot, reports CBS station WCBS.

Driscoll is assigned to the Campus Magnet High School in Queens, NY. A board of education spokeswoman said Driscoll was removed from the classroom in May.

Driscoll's bail was set at $5,000.
