The motion was filed by attorneys for Huguely last week in Charlottesville Circuit Court. The 24-year-old is accused of entering Love's apartment in May 2010 and slamming her head into a wall. Authorities said Love, of Cockeysville, Md., died of trauma to the head. Huguely was Love's ex-boyfriend.

He has been in jail since his arrest.

Huguely's attorneys contend Love died from an irregular heartbeat caused partially from taking prescription Adderall and drinking alcohol. Last December, a judge sealed Love's medical records except for information about Love's prescription for Adderall.

A hearing is scheduled for Wednesday. Huguely's trial is scheduled to begin in February.
