Police said a black Mercedes driven by Holmes' chauffer was hit by a private sanitation truck at about 9:30 p.m. on W. 33rd Street and Sixth Avenue, according to E! NewsTMZ reports that the accident caused damage to the left rear fender of the Mercedes, and that the driver was the only other person in the car.

Reports say the mother-daughter duo was leaving the Chelsea Piers recreation center, where the 6-year-old had been at a gymnastics class.

A source told People the garbage truck was turning when it hit their vehicle.

"Suri was crying in the car," the source told the magazine.

A police report was filed once the actress and her daughter were back at home, People added.

Holmes, 33, filed for divorce from husband Tom Cruise, 50, on June 28. Last week, lawyers for both stars announced a settlement had been reached. Details of the agreement were not disclosed, but reports have said the actress was granted primary custody of their daughter, with Cruise getting generous visitation rights.
