DA declines to press charges against Lakers' Devin Ebanks in alleged sex assault

(CBS) LOS ANGELES - Los Angeles County prosecutors said Wednesday they would not pursue charges against Lakers player Devin Ebanks in connection with an alleged sexual assault reported Sept. 13 because of insufficient evidence, reports The Los Angeles Times.

"Everyone in this city knows that high-profile people are often targets for those seeking money or attention," Ebanks's attorney Jeff Rubenstein said. "There is nothing here, this is not a case, end of story."

The rejection filing issued by the district attorney's office said Ebanks and the unidentified woman allegedly went out on four dates, had a chance encounter at a club and went to the player's residence, where Ebanks supposedly "got on top of her...and forcibly penetrated her..." without her consent. He then is said to have "pushed her out of his residence" according to court documents.

A sexual assault exam revealed no finding or any DNA evidence on the victim's body, said prosecutors.

"Given the lack of corroborating evidence, this case is declined for prosecution due to lack of sufficient evidence to prove this charge beyond a reasonable doubt," complaint deputy Rouman Ebrahim wrote in the report.

Ebanks will return for his second season with the Lakers on Christmas Day.
