Clogging the Courts: Mich. Woman Can Sue Restaurant Over Toilet Paper Injury
DETROIT, Mich. (CBS/AP) If you think this country's legal system is in the toilet, here's one for you...
A divided Michigan Supreme Court has ruled that 58-year-old Sheri Schooley - who broke her hand while she was reaching for toilet paper - can sue a restaurant over her injury.
The aggrieved Schooley acknowledges it's a "bizarre story." She says she was at the Texas Roadhouse in Taylor, Mich., when the cover on the toilet paper dispenser fell on her right hand, and broke it.
The court's liberal majority says a jury should decide whether the dispenser created an unreasonable risk of harm. The court's three conservative justices say there should be no liability for ordinary accidents.
Precisely why does Schooley think this is lawsuit-worthy?
The South Rockwood woman says that because of the toilet paper incident she can't type, so she can't work as an administrative assistant.
Also, Schooley says her bowling average dropped by 40 pins after she was forced to switch hands.
Why didn't she just say that in the first place?
