Gregorio Carmona Chicago Police Department

(CBS) A prosecutor says a 35-year-old Chicago man started a fire Wednesday that killed his girlfriend after he learned she was having an affair.

Gregorio Carmona is charged with first-degree murder and aggravated arson in the incident at the Northwest Side Chicago apartment he shared with 35-year-old Claudia Martinez, the Sun-Times Media Wire reports.

A police report obtained by the Chicago Tribune reportedly says Martinez' 6-year-old daughter was there at the time of the incident, but Carmona saved her from the blaze.

The Chicago Sun-Times reports that police say Carmona was Martinez' boyfriend but that he also referred to her as his wife.

Martinez' death was declared a homicide after an autopsy Friday, the Sun-Times reports.

Police say Carmona poured gasoline around the apartment and on Martinez before setting the the accelerate on fire.

Carmona was denied bond at a Sunday hearing.
