NEW YORK (CBS) Brittney Jones is trying to "punk" Ashton Kutcher by incorporating his name into the marketing materials for the release of her sex tape with Vivid Entertainment.
Vivid sent out a press release this week announcing the explicit video, noting that "Ashton's fans will undoubtedly enjoy seeing what the star himself may have experienced," the New York Daily News reports.
Jones has alleged in Star Magazine that she slept with Kutcher when his wife was out of town and later alleged that the couple have an open marriage.
The 36-year-old Kutcher, who appears to be happily married to his wife, actress Demi Moore, 48, hasn't commented on the allegations or the sex tape.
But Kutcher's attorney is working to keep his name away from the sex tape.
In the letter, obtained by TMZ.com, Robert D. Offer, claims that the line in the press release constitutes "trading on Mr. Kutcher's good name and reputation for a commercial purpose, and ... attempting to misappropriate and convert the potential economic value in Mr. Kutcher's identity to your own advantage."
