Beat the Early Show Bracket Challenge Rules

Welcome to the Beat The Early Show Bracket Challenge. In the Beat The Early Show Bracket Challenge (the "Contest"), you will compete against other participants to see who can correctly predict the outcomes of the 2007 NCAA Division I Men's College Basketball Tournament (the "Tournament") games. Submit your predictions for a chance to win the Grand Prize. You may submit your predictions beginning after the brackets are filled on March 11, 2007 (starting at approximately 8PM Eastern Time (ET)) up until 11:00 AM ET on March 15, 2007 (the "Deadline"). You will compete against other fans who have also signed up for the Beat The Early Show Bracket Challenge and your score in the competition will be compared with the scores of those fans. Entrants will earn points by correctly predicting the winning teams in the games of the Tournament. The number of points awarded for each correct pick of a winning game of the Tournament will increase with each round of the Tournament. The exact number of points awarded in this Contest is set forth in the Making Picks section below. The grand prize (the "Grand Prize") will be awarded to a randomly-selected entrant who is among the top ten percent (10%) of eligible point scorers in this Contest, as described in the Prizes section of these Official Rules. The Beat The Early Show Bracket Challenge starts Sunday, March 11, 2007 after the brackets have been announced and posted online on the Contest webpages (the "Challenge Site") accessed by clicking through the Contest link located at
https://www.cbsnews.com/stories/2007/03/05/earlyshow/main2537380.shtml and ends with the completion of the Championship Game in the Tournament on Monday, April 2, 2007 (the "Contest Period").


No Cost

The Beat The Early Show Bracket Challenge is FREE to play. No purchase or entry fee necessary to enter or win.


The Administrator

CBS Interactive Inc. ("Administrator") will serve as the administrator for the Beat The Early Show Bracket Challenge and will be responsible for resolving any disputes that arise.


Eligibility

To be eligible to participate in the Contest, you must be: (a) a Registered User; (b) a legal resident of one (1) of the fifty (50) United States or Washington DC (for purposes of clarity, Puerto Rico is expressly excluded); and (c) at least 21 years of age at the date of entry in this Contest. For purposes of these rules (the "Official Rules"), "Registered User" means a person who has successfully completed the registration form and has obtained a User Identification ("ID") and associated password ("Password") on one or more of the following Websites: CBS.com, CBSgames.com, CBSnews.com, CBSSportsLine.com, upn.com, etonline.com, NFL.com, NCAAsports.com, and/or SuperBowl.com. If you are not a Registered User you may become a Registered User and obtain an ID and a Password by completing the registration form at CBS.Sportsline.com (the "SportsLine Service") by going here on the SportsLine Service. There is no fee or charge for you to become a Registered User. Void where prohibited by law. Non-eligible individuals may play, but are NOT eligible to receive the grand prize.


Employees of CBS Interactive Inc. and CBS Broadcasting Inc. (collectively the "Contest Entities") and each of their parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies and members of the immediate family or household of each are not eligible to win. Immediate family member is defined as a parent, sibling or any person residing in the same household as an employee of the Contest Entities. Void where prohibited. Such excluded employees and/or family members may play, but WILL NOT be eligible to receive the grand prize.


PLAYING


Signing Up

Registered Users can sign up any time up to the Deadline by visiting The Early Show's section of CBSNews.com at https://www.cbsnews.com/stories/2007/03/05/earlyshow/main2537380.shtml and clicking on the Beat The Early Show Bracket Challenge icon. This will bring Registered Users to the Challenge Site. Participants may sign up for the Contest prior to March 11, 2007, but will not be able to enter their selections until after the Brackets are filled on March 11, 2007 (at approximately 8 PM ET).


Selection Deadline

Brackets will be filled on March 11, 2007 and posted on-line under the "Brackets" link on the Challenge Site. Picks must be submitted by 11:00 AM ET on March 15, 2007. The Administrator may send a reminder e-mail on March 11, 2007 to participants who have signed up but haven't yet submitted picks.


Making Picks

After you sign up, you will have access to an on-line brackets page listing 63 of the 64 eligible NCAA Division 1 Men's College Basketball Tournament teams and their round one match-ups.


Note: The 64th team will be determined by a play-in Tournament game on Tuesday, March 13, 2007. That game will not be counted in this Contest. Prior to completion of that game, the 64th team will be listed on our brackets page as "Play-In Winner," and entrants are free to pick "Play-In Winner" in the first round if they want to submit picks before the play-in that game is complete.


Entrants must enter their projected winners of all 63 games of the Tournament, round by round by no later than the Deadline. Beginning with round two, Administrator will weigh predictions for each successive round more heavily than the previous round in accordance with the table below. Points will be awarded by multiplying an entrant's number of correct predictions of winning teams in each round of the Contest by the weight assigned to each applicable round. For example, an entrant would receive five (5) points for five correct predictions of winning teams in round one, and ten (10) points for five correct predictions of winning teams in round two. An entrant will receive an individual score for each of the six Tournament rounds and an overall score, which is the combined total of each entrant's individual round scores.

PRIZE


Grand Prize

One (1) grand prize (the "Grand Prize") will be awarded to a randomly-selected entrant who is among the top ten percent (10%) of eligible point scorers in this Contest. Grand Prize winner will receive a 3-Day/2-Night trip to New York City and a visit to The Early Show set where the Grand Prize winner will have the opportunity to appear with Dave Price in a weather segment.


Prize Details & Restrictions

Prize consists of round-trip coach air transportation for Grand Prize winner and guest to New York, New York from a single major U.S. gateway airport nearest Grand Prize winner's home (as determined by Sponsor), transfers from NY airport to hotel and back to airport, double occupancy deluxe hotel accommodations for two (2) nights, a visit to The Early Show set to meet Dave Price and appear in a weather segment, two tickets to a NYC sightseeing tour and $250 cash. Broadcast of the weather segment with Dave Price and the Grand Prize winner is subject to preemption. Trip subject to producer's production schedules. Grand Prize winner will be provided a minimum of seven (7) days notice prior to travel. If The Early Show production is canceled, rescheduled (or, if for any reason, Sponsor is unable to provide the visit to The Early Show set and/or visit with Dave Price and segment appearance) or the Grand Prize winner cannot take the trip to be in New York on a date specified by the Sponsor, the Sponsor shall have no further obligation to the Grand Prize winner and guest other than to supply the trip to New York as described, minus The Early Show set and Dave Price visit/segment appearance within one (1) year from date of prize notification. If Grand Prize winner resides within a 100 mile radius of New York City, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in Grand Prize value. All other expenses relating to acceptance of Grand Prize not explicitly stated herein, including but not limited to taxes, meals, beverages, alcoholic beverages and gratuities are responsibility of Grand Prize winner and guest. Certain travel restrictions may apply. Estimated retail value of Grand Prize is $3,500. Actual value may vary based on place of departure and dates of travel. Specifics of Grand Prize travel package are subject to availability and are at Sponsor's sole discretion. Complete terms and conditions of Grand Prize trip will be furnished with prize notification. Travel must be made through Sponsor's agent on a carrier of Sponsor's choice. Grand Prize winner and guest must travel on the same itinerary and provide travel documents suitable for travel. If guest of Grand Prize winner is under 18 years of age, he/she must be accompanied by his/her parent or legal guardian. Guest (or if minor, his/her parent/legal guardian) must sign and return publicity release (unless prohibited) and an affidavit of liability release prior to issuance of travel documents. Grand Prize is non-transferable; no substitutions or cash awards allowed, except at the discretion of the Sponsor in which case a prize of equal or greater value will be awarded. Taxes are the responsibility of the Grand Prize winner. Each participant agrees to release, discharge, indemnify and hold harmless the Contest Entities, their parent companies and their affiliates, subsidiaries, advertising and promotion agencies, including Marden-Kane, and all of their respective employees, directors, officers, shareholders & agents (collectively, "Releasees") from any & all claims or liability in connection with participation in this promotion or acceptance or use of any prize. Acceptance of prize constitutes permission for Sponsor and its designees to use the name, address and likeness of winner and guest for advertising and promotional purposes without additional compensation unless prohibited by law.


Drawing/Odds/Winner Notification

Grand Prize drawing will be held on or around Tuesday, April 10, 2007. Entrants will be chosen at random from among the top ten percent (10%) of eligible entries and ties, based on overall point score. Odds of winning depend on the number of eligible entries received. Potential Grand Prize winner will be notified by phone or by email.


Legal Disclaimers

All participants agree to abide by the terms of these Official Rules and the Legal Disclaimers below, and by the decisions of Administrator, which are final and binding on all matters pertaining to the Contest.


In the event that the Contest is challenged by any legal or regulatory authority, Administrator reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, Administrator shall have no liability to any entrants who are disqualified due to such an action.


General Conditions

Each entrant also acknowledges and agrees to the SportsLine Service Terms of Service, including, without limitation, the SportsLine Service Acceptable Use Policy. Taxes, if any, are the sole responsibility of the Grand Prize winner. No substitution or transfer of Grand Prize permitted except by Administrator. Administrator reserves the right to substitute a prize for one of equal or greater value in the event that an advertised prize is unavailable.


Potential Grand Prize winner will be required to complete, execute, and return an Affidavit of Eligibility/Liability Release, and where lawful, a Publicity Release (collectively, the "Release Forms") within thirty (30) days of notification of winning a grand prize. Failure to return Release Forms timely, or if prize notification or the Grand Prize is returned as non-deliverable, or if Grand Prize winner is found not to be eligible or not in compliance with these Official Rules, may result in disqualification with an alternate grand prize winner randomly selected from among the top ten percent (10%) of eligible point scorers in accordance with these Official Rules.


Entrants agree that Contest Entities may use of their names and likeness for advertising and publicity purposes, without additional compensation, unless prohibited by law.


All federal, state, local laws and regulations apply.


Administrator is not responsible for lost, late or misdirected on-line entries or transactions, for incorrect, inaccurate or incomplete entry information whether caused by a contestant, equipment, or technical malfunction or for any human error, technical error or malfunctions. Administrator reserves the right to halt or modify the Contest at any time during the Contest Period if events beyond its control compromise the Contest's fairness or integrity. In the event that a scheduled game is canceled or preempted for any reason, no points will be awarded for that game.


Administrator is not responsible for typographical or other human or technical errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the grand prize winner or the distribution of the grand prize.


Administrator, in its sole discretion, may disqualify any entrant from participating in the Contest, refuse to award points or Grand Prize, and require the return of the grand prize, if entrant engages in any conduct Administrator deems to be improper, unfair or otherwise adverse to the operation of the Contest or detrimental to other entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during Contest registration or grand prize claim, violating any term or condition stated herein, accumulating points or prize through methods such as automated computer scripts or other programming techniques, allowing others to use the entrant's personal information for the purpose of accumulating points or prize, tampering with SportsLine.com, administration of this Contest, or intentionally trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the computer programs on this Web site. Entrant further acknowledges that the forfeiture of prize(s) and/or return of any prize(s) shall in no way prevent Administrator from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct.


Administrator reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest. This Contest is not affiliated with or endorsed by the NCAA or any NCAA team.


This contest may not be used for any form of gambling.


Rules/Winner's Information

For the name and hometown of the Grand Prize winner or an additional copy of the Official Rules, send a self-addressed, stamped envelope by October 1, 2007 to: Beat The Early Show Bracket Challenge , 2200 W. Cypress Creek Road, Fort Lauderdale, FL 33309. Specify "Rules" or "Winner List." Residents of VT may omit return postage.


Internet

If for any reason the Internet portion of this Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Administrator which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Administrator reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. In such event, Administrator further reserves the right to award the Grand Prize to the eligible participant who is among the top ten percent (10%) of point scorers as of the termination date.


Administrator assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries or transactions. Administrator is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail entry or transaction to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.


Lost or Corrupted Entries

The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, lost, late, incomplete, corrupted, stolen, misdirected, illegible or postage due entries or mail if applicable; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. The Contest Entities, and their parents, affiliated and subsidiary companies, advertising and promotion agencies, are not responsible for any incorrect or inaccurate information, whether caused by registration information submitted by end users or tampering, hacking, or by any of the equipment or programming associated with or utilized in this Contest, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Contest.


Damaged Property

Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, injury or damage to any entrants or to any other person's computer or property related to or resulting from participating in this Contest or downloading materials from this Contest.


CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR. RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.


In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.


Any entry that is incomplete, late, does not include a validly issued User ID will be disqualified.


In the event that the Contest is challenged by any legal or regulatory authority, Administrator reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, Administrator shall have no liability to any participant who is disqualified due to such an action.


Contest Errors

The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, errors and/or ambiguity: (a) in the Contest; (b) in any related advertising or promotions of this Contest; and/or (c) in these Official Rules including but not limited to errors in advertising, the Official Rules, the selection and announcement of the Grand Prize winner or the distribution of the Grand Prize. In the event of any ambiguity(s) or error(s) in these Official Rules, Administrators reserve the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s) without materially affecting the terms and conditions of the Contest.


Grand Prize Winner and Grand Prize:

The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, the selection and announcement of the Grand Prize winner, the distribution of the Grand Prize, the acceptance/possession and/or use/misuse of any part of the Grand Prize and/or any injury or damage to any entrant's or third person's property related to or resulting from any part of the Grand Prize or any part of this Contest.


Prize Taxes

All federal, state, local and other tax liabilities arising from this Contest, including, without limitation, winning the Grand Prize, will be the sole responsibility of the Grand Prize winner.


Release and Indemnity

Each entrant in the Contest, including, without limitation, the Grand Prize winner, hereby releases and agrees to indemnify and hold harmless Contest Entities and their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the grand prize, participation in this Contest and participation in any activity related to this Contest.


Limitation of Liability and Disclaimer of Warranties

IN NO EVENT WILL CONTEST ENTITIES AND/OR THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SPORTSLINE SERVICE AND/OR THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE SPORTSLINE SERVICE AND/OR THE CONTEST. IN NO EVENT SHALL ADMINISTRATOR'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $100. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE CONTEST, THE SPORTSLINE SERVICE AND THE GRAND PRIZE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. Arbitration

The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Rules, including, without limitation, the Contest. Any controversy or claim arising out of or relating to these Official Rules and/or the Contest shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of New York, in the City of New York, County of New York.


Governing Law and Jurisdiction

THESE OFFICIAL RULES AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Official Rules and/or in connection with the entering of any judgment on an arbitration award in connection with these Official Rules and/or the Contest, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the New York state and federal courts located in the City of New York, County of New York, and State of New York. The parties agree not to raise the defense of forum non conveniens.
