Anna Nicole Smith's Will Is Released

Anna Nicole Smith's will says longtime companion Howard K. Stern should be given the property from her estate to hold in trust for Smith's son, who has since died.

The 2001 document does not say where Smith wanted to be buried, but did name Stern as her executor. Smith's son, Daniel, died last year just three days after the former Playboy Playmate gave birth to a daughter.

It isn't clear how the document will affect the custody battle over the girl. Three men claim to be the girl's father, including Stern.

The attorney for Smith's estranged mother says the will is not valid because it wasn't filed in any court.

Meanwhile, a South Florida judge is allowing Smith's remains to be embalmed. But the legal fight over where to bury her, and who gets custody of her baby, will resume Tuesday.

Her body has been with medical examiners since the 39-year-old died at a Florida hotel on Feb. 8.

Seidlin also ordered Stern, who did not attend today's hearing, to appear in court Tuesday.

Seidlin already has ordered that additional DNA be taken from Smith's body in the ongoing fight between Stern and photographer Larry Birkhead over who fathered Smith's 5-month-old baby, Dannielynn.

Her estranged mother, Virgie Arthur, wants her buried in Smith's home state of Texas.

The court recessed around noon for the holiday weekend.
