Andrea Sneiderman Update: DA to drop murder charges against Ga. woman accused of conspiring to kill husband, report says

(CBS) ATLANTA - A county district attorney in Georgia plans to drop murder charges against Andrea Sneiderman, who's accused of conspiring with her boss to kill her husband outside a suburban Atlanta preschool, sources tell CBS Atlanta.

Sources told the station that DeKalb County District Attorney Robert James still plans on prosecuting Sneiderman on charges of perjury and making false statements, in connection to the November 2010 shooting death of Rusty Sneiderman.

Andrea Sneiderman was reportedly having an affair with her employer, Hemy Neuman, who is serving a life sentence for the killing.

Sneiderman faces 13 lesser charges - four counts of perjury, seven counts of making false statements, one count of hindering the apprehension of a criminal and one count of concealment of material fact - that carry sentences of up to five to 10 years each, the Atlanta Journal-Constitution reports.  

A gag order prevented the DA's office from commenting to CBS Atlanta, but sources reportedly said the charges were dropped after Andrea Sneiderman's defense team unveiled new evidence.

Bob Rubin, who represents Neuman, told WSBTV he was "deeply disappointed" that prosecutors would not pursue the more serious charges, which include felony murder, malice murder and aggravated assault.

"Hemy did shoot Rusty Sneiderman, but we believe he did it after being manipulated by Andrea Sneiderman, and we think she should face those charges," Rubin told the station.

A hearing is set for Friday to discuss a possible witness in the case, CBS Atlanta reports. Jury selection in the trial was set to begin Monday, reports the Journal-Constitution.
