Accused Halle Berry stalker suspect charged with felony

(CBS/AP) - A man who was arrested outside Halley Berry's home has been charged with felony stalking.

James Franco, 27, was arrested late Monday after off-duty police officers saw him jump the wall of the actress' Hollywood Hills home. Authorities say it was the third time he'd been spotted trespassing on the property since Saturday.

He remains jailed and is expected to appear for arraignment in a downtown Los Angeles courtroom Wednesday.

If convicted of stalking, Franco faces up to three years in prison. 

According to the Los Angeles Times, Franco is on probation after pleading no contest in June to a misdemeanor battery charge.

The Oscar-winning actress obtained a civilrestraining order against Franco on Tuesday, saying she was "extremely frightened" of him. The order remains in effect until Aug. 1 and also protects Berry's 3-year-old daughter Nahla. 

Berry filed and was granted a restraining order in 2004 against a then-35-year-old Louisiana man who claimed God told him to marry Berry.
