Zoning The Palm Desert Party?

PALM DESERT (CBS) — Palm Desert City Council will consider a proposed zoning ordinance tomorrow aimed at regulating short-term rental homes.

According to city spokesman David Hermann, the ordinance will require conditional use permits for residential properties that are rented out for 30 days or less -- sometimes referred to as "party homes". The proposed change is in response to issues with noise, parking and parties involving homes rented out for less than 30 days but would not apply to home within gated communities.

If the law is passed, homeowners within 300 feet of the party zone, will be notified of a hearing if someone wants to rent it. The hearing will be a requirement for potential renters to be granted a permit. Stipulations in the ordinance would include limiting occupancy to two people per bedroom, with an additional two allowed in the daytime, and requiring a minimum stay of three days and adequate room for parking.

Property owners already renting short-term residences legally –- that is with a city-issued business license -- could be grandfathered in by registering with the Community Development Department within 90 days.

The Palm Desert Planning Commission voted 3-2 on February 15th, to put the measure before the council. Tomorrow's vote was originally scheduled for two weeks ago, but it was pushed back so city lawyers could review the ordinance.
