Anna Homeowners Blame Builder For Drainage Problems

ANNA (CBS 11 NEWS) - Endangering pets and potentially ruining homes, that's what some neighbors in an Anna subdivision say their builder has done by failing to fix drainage problems.

The mud on the hill behind Jessica Gann's home is just the beginning of the problem. She says her backyard hasn't been dry for most of the past year because storm water runs down the hill and collects here. Gann says the water creeped into her house and ruined her carpet. Then, she says, the problems only got worse.

"We moved here. He started getting really sick from eating the clay," Gann said.

It isn't just water that comes through the bottom of her fence. Gann claims clay from the hill is what killed her Great Dane, Tiger.

"It was heartbreaking. He's my best friend," Gann said.

Other neighbors have also complained about pets getting sick. That's why Erik Kennedy says he keeps his dog away from the standing water in his backyard.

"This right here, all this standing water, who knows? It could be a foundation issue in two or three years unless it gets fixed," Kennedy said.

Many of the new homeowners blame their builder, D.R. Horton. In a statement to CBS11, the company wrote, "We have implemented repairs to address the drainage, and we will continue to work with our homeowners in the community to assist in this matter."

But some of the neighbors say those repairs aren't enough – and the problems persist.

"It's come to the point where if I have to, legal action could be taken," Kennedy said.

"Something needs to be done about this hill, so that we can enjoy our home. We all paid really good money for these homes, and we expect to be able to enjoy them," Gann said.

Some of the drainage is affected by conditions that exist on property that is not owned by D.R. Horton or our homeowners, but we remain committed to working on their concerns.
