Settlement Reached In Marin County Sewage Spills

LARKSPUR (CBS/AP) - A Marin County sanitary district has settled its lawsuit against a South San Francisco-based construction company over two sewage spills that discharged more than 2.5 million gallons of wastewater.

The Marin Independent Journal reports that JMB Construction Inc. has agreed to pay the Ross Valley Sanitary District $630,000.

In return, the district will turn over nearly $1.9 million in back fees and other payments it had withheld from JMB during the suit.

The settlement was announced in San Francisco Superior Court last week.

The district claimed JMB damaged a sewage line and was responsible for construction debris in one or two lines, causing the spills in December 2010.

About 1.8 million gallons of sewage poured out in Larkspur amid heavy rain on Dec. 22.

An 840,000-gallon overflow in Kentfield occurred days earlier.

JMB said the district was to blame for the spills.
