Smith's Mom Granted Injunction By Judge

A Bahamian judge Tuesday granted Anna Nicole Smith's mother, Virgie Arthur, an injunction that prevents Smith's partner, Howard K. Stern, from taking 5-month-old Dannielynn out of the Caribbean country, the Daily News reported Wednesday.

The order comes after Smith's mom begged the court to take action, the report said. Arthur reportedly fears for the safety of her 5-month-old granddaughter as long as she remains with Stern.

Smith's son, Daniel, died in September while visiting his mother, Dannielynn and Stern in the Bahamas.

Stern, who is listed as the father on Dannielynn's birth certificate, insists he is the father of the baby girl. Two other men claim to be her father as well.

Arthur believes Birkhead is the baby's father. "I'd like to see the baby. I'd like to see Larry have the child," she told the Daily News.

Arthur's friend David Lee explained that her mother blames Stern for the deaths of her daughter and grandson, Daniel Smith.

"There's two common denominators in the deaths of her daughter and her grandchild — drugs and Howard K. Stern," Lee said.

Police said that no illegal drugs were found in Smith's hotel room. An autopsy found no pills in her stomach, but officials are awaiting the results of toxicological tests.

"She (Arthur) will do whatever she can to get this child away from the man (she blames) for two deaths," Lee said. "She is very, very fearful for the child's safety."

According to the newspaper, Bahamian authorities say Stern could face more questioning by police about Daniel's death given the similar circumstances in both deaths.

"Because of the incident that happened in the U.S. with Anna's death, I think we would want to talk to him again," chief magistrate Roger Gomez told the Daily News.
