Date Set In Paternity Case Against Smith

A judge has given Anna Nicole Smith until Jan. 23 to have her baby girl undergo paternity testing sought by a former boyfriend who claims he is the father, the man's attorney said Tuesday.

Superior Court Judge Robert Schnider ruled in favor of Smith's ex-boyfriend Larry Birkhead last month. It wasn't known when the former Playboy playmate's daughter might have the DNA test.

"We can't make it any easier for her," Birkhead's attorney, Debra Opri, said.

In a message posted on LarryBirkhead.net, Birkhead said he's still hoping to see the child. "I haven't given up hope that I will soon see my baby daughter," a message on the site said.

Also on the Web site is a photo of Dannielynn Hope and a photo of Birkhead as a baby.

An after-hours phone message left Tuesday for Smith's lawyer, Ronald A. Rale, was not immediately returned. He had previously declined to discuss the judge's ruling. Paternity cases are typically confidential.

Smith, 38, gave birth to Dannielynn Hope on Sept. 7 in the Bahamas. Birkhead, 34, sued in October to get a paternity test and claims the child was conceived in the Los Angeles area.

Smith's longtime personal lawyer, Howard K. Stern, maintains he is the baby's father.
