911 Caller Proclaims Innocence Despite Pleading Guilty To False Report That Led To Teen's Death By Police

PASADENA ( —The 911 caller who falsely reported he was robbed at gunpoint in Pasadena, which led to the fatal shooting of a college student by police, is proclaiming his innocence despite entering a guilty plea in court.

Oscar Carrillo pleaded guilty to two misdemeanor false reporting charges Monday. He will serve 90 days in jail, perform 90 days of community service and pay $3,000 to the Pasadena Police Department.

On March 24, 2012, Carrillo told an emergency dispatcher he was being robbed by two armed men outside his taco truck. In the call, he mentioned a gun eight times.

Officers then shot and killed Kendrec McDade, 19, who was unarmed.

"When the guy got shot, I guess, I didn't even know it was the same guy who stole from me. And now they blame me because I (made) the phone call," Carrillo said.

Carrillo told CBS2's Bobby Kaple that he felt pressured by the dispatcher into saying McDade had a gun.

"Maybe because I (felt) scared that night. It does not mean I'm guilty," he said.

Pasadena City Attorney Michele Beal Bagneris, the prosecutor in the case, said Carrillo is guilty—whether he feels that way or not.

"He has entered that plea to the court," she said. "I think it's important that people know that there are consequences for making false 911 calls and false comments to the police department."

Carrillo, who faced four and a half years in jail on several counts, said he cut the deal with prosecutors to put the situation behind him.

Carrillo also apologized to McDade's parents.

"Maybe I can be wrong, but that does not mean…why didn't they shoot the leg? Why didn't they shoot (other parts)? I didn't even know he was shot seven times," he said.

McDade's mother, who didn't wish to appear on-camera, said she was not happy with the outcome of the plea deal. The family has filed a wrongful death suit against the city of Pasadena and several employees in the police department.
