A former kindergarten teacher is accused of sexually abusing students at school. His alleged victim is fighting for justice and sharing her story with CBS 2 Investigator Dave Savini.
"We perceive no clear error in the district court's determination that the government has demonstrated by clear and convincing evidence that Kelly presents risk of a danger to the community and by a preponderance of the evidence that Kelly presents a flight risk," the ruling states.
Defense attorneys Tom Farinella and Doug Anton told CNN that Kelly is now in the special housing unit at the Metropolitan Correctional Center in downtown Chicago.
The feds also argued jurors will hear evidence Kelly is "capable of inflicting violence," which might affect their impartiality if they are aware their names will be public.
Indicted singer R. Kelly is seeking to be released to home confinement and electronic monitoring at his condo in the South Loop.

"It is a fact that people who are diabetic are at a much higher risk for serious complications should they be infected with Covid 19," Kelly's attorney wrote in a filing in federal court.
"That Mr. Kelly will be infected with this deadly disease, is now unfortunately an absolute probability," Kelly's lawyers argued.
Kelly, 53, has been held at the Metropolitan Correctional Center since his arrest on federal charges in Chicago and New York last July.
Kelly's defense team says the racketeering case in New York is an attempt at an "end run" around the statue of limitation on the underlying claims of illegal sexual activity.
