Drunk Mo. Man Found Not Guilty of Drunk Driving; Unusual Defense Prevails

JACKSON, Missouri (AP) A Missouri man who drove off an icy road was found drunk in his car, stuck in a ditch. He claimed he didn't start drinking until after the crash.

A jury agreed.

Thomas Drummond was acquitted of drunken driving after testifying he only consumed alcohol - brandy - to keep warm after he skidded off the road last February.

Drummond told the court he wasn't intoxicated behind the wheel, but that he was by the time emergency workers arrived more than two hours later.

The Southeast Missourian reports a jury acquitted Drummond last week.

Defense attorney Stephen Wilson says it was a set of facts you don't see every day.

"It was the day before the Super Bowl and he had just done some shopping," Wilson said Monday. "It was 32 degrees or colder out and he had brandy in the car, so he kept warm."

No doubt Drummond is warmed by the verdict, too.
