Danielle Staub Wants Ex-Husband's Lawsuit Against Her Thrown Out of Court

NEW YORK (CBS) Danielle Staub wants her ex-husband's $5 million defamation lawsuit thrown out of court.

Staub says Kevin Maher is everything she claimed him to be in her latest memoir "The Naked Truth," which describes Maher as an abusive husband who made her live in fear for her life.

TMZ.com reported on Aug. 27 that Staub filed legal papers stating that Kevin Maher has "no evidence" that Staub ever made several controversial statements about him including accusations that Maher "killed her dog, forced her to play Russian Roulette and even raped her."

The gossip site reported that Maher filed a lawsuit against the "Real Housewives of New Jersey" star -- claiming she did make the alleged statements and in doing so, she damaged his reputation to the tune of $5 million.

Maher and Staub reportedly want to settle their issues through mediation. On Friday both sat down for a mediation session that lasted nine-and-a-half hours, according to E! Online. But in case that fails, the case is set to go to trial in February.
