Aguilera, 30, and boyfriend Matthew Rutler, 25, were arrested early Tuesday morning in West Hollywood, Calif. Rutler was charged with driving under the influence, Aguilera with public intoxication. L.A. County Sheriff's spokesman Steve Whitmore said in a press conference that police stopped the car at approximately 2:45 a.m. local time after observing erratic driving.

"[The driver's] passenger was Miss Aguilera," he said. "It was kind of a unique situation. She was not capable of taking care of herself."

There are no plans to prosecute Aguilera, he said. "She was booked, she was fingerprinted, she was put in a cell."

He said it was a public safety issue. "Once she was able to navigate and think on her own, she was released at about 7:30 this morning."

Regarding Rutler, he said, "Bail is $5000.00, not $30,000.00, and the person is in the process of bailing out."
