Brianna Denison Judge Will Likely Allow Porn Evidence

RENO, Nev. (CBS/AP) The judge in the case of a Nevada man accused of killing 19-year-old Brianna Denison and sexually assaulting two other young women says the jury will most likely be allowed to hear and see evidence of James Biela's alleged fetish for women's thong underwear.

Washoe District Judge Robert Perry also ruled Monday that Biela's ex-girlfriend will be allowed to testify during next month's trial about the websites he frequented featuring photos of young girls and thongs.

But the judge says no one can refer to the sites as "porn."

Biela could face the death penalty if convicted of kidnapping and strangling Denison in 2008, then dumping her body and two pairs of thong underwear in a Reno business park.

His two other accusers allege he took their underwear after assaulting them.

The new ruling is largely a victory for prosecutors, but the judge pointed out that they will have meet the normal legal tests at the time of the trial in order for the material to be formally introduced into the case.
