Portwood surrendered to Anderson, Indiana police according to her attorney, reports CBS affiliate WISH

Detective Mitch Carroll told The Herald Bulletin that the child neglect charges stem from Portwood's young daughter being present during two filmed instances of domestic abuse.

"Amber is scared," Amber's brother, Shawn Portwood, told E! News. "Gary is here with us. He's upset, too."

Her attorney told WISH that Portwood has posted bail, but had to remain in jail overnight.

Anne Houseworth of the Indiana Department of Child Services said dozens of viewers called the state's child abuse hotline to report Portwood's outbursts.

Despite the video evidence, Portwood maintains her innocence and claims that the events described in police documents never occurred in front of her daughter.

According to E! News, Portwood, who was jailed under a 24-hour hold until Tuesday afternoon, is facing up to three years in jail and a $10,000 fine if convicted.
