(CBS News) Even though a judge declared a mistrial in Nicollette Sheridan's wrongful termination case after jurors could not reach a verdict on the claims of the former "Desperate Housewives" star, some are saying the actress' case looks good if there is a retrial.

Travis Gemoets, a partner at Jeffer Mangels, told E! News that because the jury was split 8 to 4 in favor of Sheridan it gives her and her team confidence moving forward, with the knowledge that they do have a case. He added that Sheridan will have an advantage the next time around because she already knows all of the defense's tricks.

But, there may not be a second trial. Gemoets told E! that ABC Entertainment may offer Sheridan a settlement because of her favor with the jury in the first trial.

Sheridan was seeking roughly $6 million in damages on the claim that her character Edie Britt was killed off in retaliation for her complaints that series creator Marc Cherry struck her on the show's set in September 2008.

Cherry and ABC, which airs "Housewives," have denied wrongdoing. The veteran TV writer testified he had authority to kill of Sheridan's role four months before the incident.

The jury was released Monday after they reported they were deadlocked.
