Police said the two boys were playing when the older boy reached on top of the refrigerator and grabbed the loaded handgun and then accidentally shot the younger boy in the face.

Prosecutors say Santiago was a former gang member and bought the gun in a street sale because he felt he needed it for protection.

Santiago's next hearing is scheduled for Nov. 9.
