Report: Administration Web Site May Have Broken Laws

(AP)
A nonpartisan congressional research group is backing up a Republican senator's claim that the U.S Health and Human Services Department (HHS) could potentially be inappropriately culling support for President Obama's health care agenda.

The department may have violated laws relating to federal spending on propaganda or lobbying campaigns by hosting its "State Your Support" health care Web site, according to the Congressional Research Service. The CRS gave its legal opinion on the matter at the behest of Sen. Charles Grassley (R-Iowa).

The "State Your Support" page provides a form letter to Mr. Obama for citizens to submit, after adding their name and personal information.

"By signing this statement we affirm our commitment to work with you and our Congressional leaders to enact legislation this year which provides affordable, high quality coverage for all Americans," the letter says.

In a letter (PDF) he wrote last month to HHS Secretary Kathleen Sebelius, Grassley asked the secretary to answer a number of questions about the online letter.

"The use of the official HHS.GOV website for activities that seem to be nothing more than government propaganda raises many serious questions," he wrote.

Sebelius wrote back (PDF) that the Web site is "entirely legal and proper" and aims "to provide the American public with an opportunity to participate in the dialogue."

In its analysis (PDF), however, the CRS wrote, "It would appear to be a legitimate inquiry as to whether the department is expending federal funds for such 'informational' or 'educational' purposes, or rather expending funds to expressly urge the public to engage in a letter writing campaign involving an electronic submission of a form letter to a government official (sometimes referred to as 'astroturf' lobbying, that is, an artificially stimulated letter writing campaigns) urging the adoption of a particular public policy in legislation this year."

A statement on Grassley's Web site claims that "past statements by White House officials make it clear that initiatives like 'State Your Support' are part of a strategy" to promote the president's agenda.

The only way for the Congressional lawmakers to find out the will of the people is to hold a Nationwide special election, and have the people vote on the issue, in other words a plebiscite.
The hard part of this is allowing all the choices available to be properly stated, but at least the people's will can be made known accurately.

As I recollect the Bush admin paid journalists to write op-ed opinions in favor of his policy du jour.

No administration should use gov resources including payments for propaganda to promote their agenda.

In other words, you are saying that the Obama administration is guilty as charged in this story, yet the name "Bush" is the only one you mention. Your brainwashing has set in completely!
by hakori November 8, 2009 11:12 AM EST
redmooseak, and where were you when Bush lied us into war, or when he was spying on you, or when he was torturing in your name, or when he stamped out dissent, when he redistrubuted the wealth upwards or when he bailed out the banks? What's that? Oh, you supported him. Don't talk to a democrat about brainwashing. Your definition of who has been brainwashed is anyone who disagrees with you.

There is always a secondary choice. Instead of complaining about it in a few words. You posters here should pool your money and start your own propaganda web site to shine light on what you believe to be a injustice or misuse of tax payers money.Im guessing you posted these statements on your way out the door to a job probably not worth going to {you think] Or you just want to bi---h and complain.YOU NEED TO HIT YOUR KNEES AND THANK GOD YOU HAVE THE MARINES WATCHING OVER YOU WHILE YOU SLEEP.MOST OF YOU COULDN'T SPELL PROPAGANDA UNTIL THEY POSTED HERE.

You could be right. Still, I don't want my tax dollars used by either side to stick something in front of me without giving me a 50-50 option to go one way or the other. I would also like to put in my 'two-cents' worth on anything, since it is my dime. You have to admit that there may be something to this Health Care thing, where the democrats want to keep out republicans, nobody is permitted to read what Congress wants to make law, and the President is scrambling for reasons why he can't keep his promises on taxes. First and foremost, I hope the Marines are like the Army and support America and it's people before Congress and the President.

rocketjl, what the heck do you mean the dems want to keep out republicans? The republicans have kept themselves out! Their objective is no health care reform! What do you mean nobody is permitted to read this bill? It's on line, read it! Calling for a militray overthow is treason! What do you not understand about the congress and president being elected by the majority. THEY REPRESENT THE PEOPLE! What you are saying is you prefer a military over throw when your party is out of power? It this what you really think America is about? Do really wonder why so many are saying the GOP has been reduced to a bunch of radicals? Keep up this nonsense and see how long your pathetic party of radicals say in the wilderness!!!

rocketjl, another thing about you righties: you clammer for impeachment when a president lies about sex and you say it's not about the sex it's about the lies. Excuse me, but if it wasn't about the sex why was it ever an issue? Bush comes to power and commits numerous impeachale offenses and you keep you mouths shut. Surprise, surprise another democrat is in office and you people scream for impeachment agian. See the pattern here? When you loose, you still want to win by nullifying the results! And you call liberals unAmerican!? Grow up!

Like sheep to the slaughter- ignorant, indifferent, petty, unable to see the danger before them. Call evil good and good evil. Unable to even discern truth. Living by: what's in it for me, what's his is mine, i want it now, i am entitled to_____, they owe me this, there are no accidents- someone must pay, whocanisue.com, let's gamble with our children's future, the ends justify the means, etc. on adnausea. So long freedom, hello slavery.

smac761, another rambling rightie! If the government is so frickin bad, I suggest you stay home and never use the public roads; public transportation; take a social security check; medicare reimbursment; use a public library; drive over a bridge; never take an umeployment check if you loose your job 'cause that's socialism; never take any federal assistance if you're involved in a disaster; don't expect the government to come to your aid if you are discriminated agaisnt because of your sex, age, religion or handicap--and soon to be sexual orientation; in fact, just don't expect anything. What is lost on you righties is that there's federal spending in this country: always has and always will as long as we're a viable republic. The issue is how it's spent, and all you people think it should go for is defense--which is necessary--and lining the pockets of the rich. You want to gamble our kid's future, buddy? Then let things stay exactly the same and see how your kids can afford health coverage, because in another decade of the the status quo they'll all be charity cases, as will you! It's pathetic how you on the right consistantly side with those who work against your own best interests. But then again it soooo easy. They say what you want to hear and they screw you all the way to the bank.

In other words, Grassley wants the MILLIONS of dollars in bribes from the insurance companies to keep flowing, and he doesn't want that pesky "health care for all" to get in the way.

"Let them eat cake", is that it Chuck?

When aprised of the findings of the CRS President Obama responded with "That can't be illegal, it's the way we've always done it in Chicago." :))

Surprise, surprise, and I'd bet big money that this administration is breaking many more laws. Eventually they'll be called to task and get their due.

Yah, yah, yah, just like the previous crooks in the Bush administration didn't break any laws. Change the station so you can see what the real world is like outside of Rush & Glenn.

Sebelius wrote back (PDF) that the Web site is "entirely legal and proper" and aims "to provide the American public with an opportunity to participate in the dialogue."

No, it provides supporters of Obamas policies to state their support. If they wanted to give the public the opportunity to participate in the dialogue it would not have been a form letter that only allowed adding personal information. It would have been a questionaire to get opinions from both sides of the debate. This just shows the deceit that the Obama administration uses.

This just shows the deceit that the Obama administration uses.

Along the same lines of deceit as the bush republican administration USED?????
by velma179 November 7, 2009 10:13 AM EST
No deceit.

The letter IS for those who support Mr. Obama's stated position.

If you don't support it, you don't submit the letter -- it really is that simple.

And, if you will read the article, there is nothing that says the HHS site is actually illegal.

Sheesh, I knew some of you would jump on this like it was a proven fact, rather than merely a protest from an opponent.

By the way -- it is not illegal. In order to "lobby" someone, you have to be dealing with an individual that could be influenced by your actions. President Obama has CLEARLY, already made up his mind about health care legislation.

Try again, Grassley and the losing team... and I am sure you will. Keep up your work on behalf of your "owners", the Insurance Industry.

Government bureaucracies are supposed to implement laws passed by citizens through their representatives. Promoting legislation is a conflict of interest and should be punished with heavy fines and expulsions.
