Roman Polanski Rape Victim Samantha Geimer (Photo) Wants Case Dismissed

NEW YORK (CBS/AP) Roman Polanski’s rape victim, Samantha Geimer, who identified herself long ago, is asking that the Oscar-winning director’s case be dismissed.

If Polanski is brought to an American court, Geimer, who is now an adult and living with her husband in Hawaii, cannot be forced to testify against him. What she really wants, she says, is for the case to be over. Geimer has already sued him and reached an undisclosed settlement. She filed court papers earlier this year asking the charges against Polanski be dismissed, according to CNN.

But clearly American authorities have different ideas.

Polanski, 76, director of "Chinatown," "Rosemary's Baby" and the Oscar-winning "The Pianist" was arrested Saturday as he arrived in Zurich to receive a lifetime achievement award from a film festival.

Authorities in Los Angeles consider Polanski a convicted felon and fugitive, and a Swiss justice official said there has been an international arrest warrant out on him since 2005.

Back in 1977, the director had pleaded guilty to unlawful sexual intercourse with a then 13-year-old Geimer, who said Polanski performed oral sex, intercourse and sodomy on her after giving her champagne and part of a Quaalude pill at Jack Nicholson's house while the actor was away.

Polanski has called the girl a sophisticated teen who willingly had sex with him. The court didn't see it that way.

He was sent to prison for 42 days, but the judge tried to renege on the plea bargain. On the day of his sentencing in 1978, aware the judge would sentence him to more prison time, Polanski fled to France.

He is currently in a Swiss prison, awaiting a decision on whether he will be extradited to the United States. Swiss officials have said he will likely not be released until a court has ruled - a process that could take weeks.

Okay first off to the dullards that take a jab at this woman's desire to put this behind her.

First off - Who wouldn't want to push forward and leave this past behind them? Second, she has been requesting this LONG before Polanski's capture. Third, you seriously think the media did not approach her regarding this?

He fled, she settled out of court and wants to leave this all in the past. Not too hard to imagine, really. And no, not everyone who is the victim of a crime suddenly wants to make that crime their life's work or champion the cause.

Doesn't the Polanski apologizing media understand it, there is no case to drop. The case was over when he plead guilty. Then he decided to skip town. He should serve the remainder of his sentence then be prosecuted for evading justice.

Mr. Polanski made movies, there is nothing significant about this to warrant him not being able to serve time for raping of a young women. I don't give a damn how old this girl looked! Once she opens her mouth it should have been a clear indication of her innocents and not for him to rape her. If the bastard would not fled from justice no one would be saying anything if he served his time. Yet Polanski didn't serve his time and now or possibly maybe for the rest of his life in a jail cell. Jerk!

Some of you are two faced. It was ok when David Koresh and his lunatics were sleeping with children and impregnating them. Some of you even took up arms against the government, all those militia people, blew up a federal building and the atlanta olympics. You had no quarrel with that and now that this french guy slept with a 13 years old,(and who knows if it was consensual)you cry to the heavens.....

You keep making stupid statements mejordalahistoria. There is something called "Age of Consent" and it isn't thirteen. If I ask my three year old if she wants to drink beer she will say yes or no without understanding the distinction. We put these laws in place for a reason, it isn't up to the victim whether to press charges it is up to the state and the state decided to prosecute as they should. Polanski is a felon who plead guilty but has escaped punishment to date. Stop making stupid statements as if you know what you are talking about.

This rapist needs to rot in prison for his crimes he ran from the law in 77 because he knew it was wrong then just like it is now. The crime no matter how severe then is still a crime today despite how emotionally confused his victim feels. Justice will eventually be served when this guy dies in prison becuase no amount of fame fortune and glory will save him from where he is going.

It's not just about the rape (although of course that should be more than enough to put this sicko away), it's about fleeing the country to avoid sentencing. This jerk thumbed his nose at our justice system and has lived a pampered life of luxury ever since. He never would have gotten away with it for so long if he wasn't a celebrity. Thankfully his time is up and it's time to pay the piper.

People know who she is because she identified herself. The law did protect her identity. If she is under media scrutiny now she brought it on herself. Me me me. Great she has gotten over it. How about her parents. If it was my child I would feel like screaming for the rest of my life. How about other victims? If not of Polanski than other people who have suffered abuse. Are they supposed to have gotten over it too? This woman has an opportunity to make a stand for victims' rights many of whom like Mackenzie Phillips go their entire lives without even verbalizing what they went through. If Geimer really has a problem with all the attention on her why doesn't she keep her mouth shut.

Makes no difference if she testifies or not.
Makes no difference how "sexually sophisticated" she was.
It is ILLEGAL for a man to have sex with a child. Period.

Polanski not only committed a crime against this child, he committed a crime against the state. He should do 10 years for raping this child, and ten years for evading justice.

Why would you politicize something that isn't about politics. Polanski committed a crime. It is a crime no matter who does it he didn't pay for his crime against a child. So tell that to Republicans, Democrats, Libertarians, Green etc. enforce our laws. You are an apologist idiot.

Polanski is kith and kin to sexual perversion, morbid mental illness and homicide. His poor pregnant wife was murdered while pregnant and she knew of Polanski's infidelities. Polanski's films like "Repulsion", "Chinatown" and "Knife In The Water" demonstrate a man who is willing to step out of the bounds of decency and it is no wonder that he would sodomize a 13 year old after giving her alcohol and tranquilizer. He has to face his punishment like a man. If Polanski is afraid of prisoners he can be placed in protective custody. After all, he FORCED this 13 year old girl when he was over 40.

I just wonder who the 'real' criminals are. Are they the ones who don't make movies? Are they the ones who don't star on TV? Are they the ones who can't afford to flee the country when they rape 13 year old girls. A girl 13 can no more give her consent to sex than a child can. Oh, wait a minute, she is a child. Hollywoods reaction to this affair shows just how out of touch with reality those phony people are. Society would be better off without them.

Roman Polandski drugged and rapped the little girl. Probably not his first. He did the crime, finally admitted it and escaped failing to do the time. Fleeing is a crime in inself. I believe he needs to do the full sentence for the rape plus time for avoiding incarceration. If he dies in prison great. Juctice served!

As others have said this is no longer a rape case. What the victim wants no longer matters (she reached an out-of-court civil settlement with her attacker). This is a case of flight to avoid prosecution... something any government takes very seriously. If the State Of California didn't try hard to get this sleazeball back alot of accused folks would be zooming out of the state's jurisdiction to avoid prosecution. This is all about the State of California flexing its muscles. And the only thing that will stop that flexing is the Feds-- submitting to the urgings of foreign governments-- yanking the carpet out from under the state.

This is more about politics than it is about justice.

Go to the smoking gun and read the grand jury minuets. The French did not they play the crime down. The victin reported that he raped her front and rear and she did tell him not to do this,. they tend to forget he pled from foricable rape down to satituary rape !

Do not rush to judgement on either side . Anyone interested in the facts of this case should see the documentary Roman Polanski : Wanted and Desired . It is is a real eye opener about our legal system , atleast how this particular case went down .

There is no 'judgment' to rush to - he pleaded guilty to the charges, ergo he said he was guilty. He paid her off years in a civil settlement after the crime, again he said he was guilty - now the state wants him to stand before the state and pay the state's price for the crime he admitted he did.
