Gun-Toting Man Draws Scrutiny Outside Obama Town Hall

New Hampshire state law is pretty clear about protecting its citizens' rights to carry firearms in public. Carrying a pistol or revolver openly is permitted without a license; carrying a concealed weapon requires a license from the state or local police.

William Kostric took advantage of that law on Tuesday to show up outside President Obama's Portsmouth, N.H. town hall meeting and hold a sign saying "It Is Time To Water The Tree Of Liberty." That invokes a phrase from a letter written by Thomas Jefferson: "The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants."

Kostric did not immediately respond to an interview request from CBSNews.com.

Portsmouth police spokesman Lt. Frank Warchol told the Boston Globe that because Kostric was on private property -- it belongs to a church near the school with the town hall meeting -- he would not be arrested. "We can't do anything about it," Warchol said. "Obviously he's on our radar screen at this time."

Kostric was there around 11 a.m. ET, before Mr. Obama even left the White House en route for the Granite State, and there's no indication he ever laid eyes on the president. Nevertheless, around that time (11:35 a.m., to be precise) MSNBC's Carlos Watson called for Kostric to be forcibly disarmed: "I cannot imagine that there aren't enough lawyers in New Hampshire who can't file some sort of emergency injunction." One of his guests added: "Why can't we get rid of him now?"

MSNBC's Chris Matthews invited Kostric on his show and wondered why "you're carrying a goddamned gun at a presidential event?" (Kostric's reply: He was there peacefully, guns aren't unusual in New Hampshire, and Americans lose rights unless they exercise them.)

One MSNBC.com report indicates that Kostric was approached by a detective, possibly a Secret Service agent, who told him he could be arrested within 1,000 feet of a school with a weapon under a federal law.

Some background: the 1990 Gun-Free School Zones Act said that it "shall be unlawful" to possess a firearm within 1,000 feet of an elementary or secondary school.

That law is no longer on the books. In the case of U.S. v. Lopez, decided in 1995, the U.S. Supreme Court said violated Congress' powers to regulate interstate commerce and was therefore unconstitutional.

Congress re-enacted a version in 1996 with a narrower definition of interstate commerce; it says the statute does not apply "on private property not part of school grounds" or to anyone with a carry permit, with Kostric may or may not have.

It's reasonable to not understand the intricacies of gun laws; many vary from state to state, and few are written especially clearly.

But you'd hope that television commentators would take the time to learn at least a little before calling for measures such as court injunctions and disarming by police. One thing that MSNBC's hosts could have added is that a lawsuit filed last week in Washington, D.C. seeks to establish a broad Second Amendment right to carry firearms in public -- which, if successful, could mean that William Kostric's exercise in public handgun ownership will become much more commonplace.

No firearms/guns other than Official Presidential Protection should be allowed near the President or Vice President (or any Official of our country), Presidential speech or otherwise. I'm recalling that peaceful protestors (without any firearms/guns) wearing t-shirts with slogans that questioned bush's motives, were escorted away from any areas where Bush was making speeches, and here in NYC, during the Republican National Convention... many bicycles were taken away from riders/protestors, and impounded by the city police(without any charges being filed), with many bicyclists being penned in with nets. If any protestors openly carried guns and rifles in view of where Bush was giving a speech, do you think it would have been tolerated? No! Those people would have been arrested and their firearms confiscated. And it is not something that Obama's security team should be allowing. The media should inform the public as well that no firearms can be brought near our President or Vice President during speeches, etc., or they will be confiscated; period. Protestors in favor for the NRA and what stands for/means to them, can wear t-shirts and carry signs like any other "normal" peaceful protestor.

Revolting against Corporate Greed??? The reasons most people voted for the president are: liberal ('not involved in Iraq war')and African American (from Hawaii).
As for the guy with the gun, he never fired a shot, never un-holstered his weapon, had a permit, had permission to be on the property. He was perfectly legal in all his actions!!! He went there to protest Obama's actions, which have not been that legal!! Where does it say he can seize banks, and privately owned businesses??? Where were the warrents mandated by the constitution? Where was the probable cause of a crime?
ABSOLUTELY NONE existed!!! If anyone should have been the president, for theft!!!

I personally would have felt safer for myself, my wife and my child standing near Mr. Kostric during this event. He is a law biding citizen who loves and values his constitutional rights! (they are not constitutional privilages chitown) I dream of a world where more law biding citizens bear arms! If guns were outlawed, then only outlaws would carry guns. Guns don't kill people, people kill people! I actually had a neighbor that killed his wife with a hammer. I believe that he had a firearm in the household. Which leads me to another point... Any weapon can be used as a tool, any tool can be used as a weapon. Let's outlaw hammers!

It seems to me that Mr. Kostric was doing everything possible to try to get a confrontation with authorities/police so he could have a public forum on gun rights. It is sad he got the forum anyway.

This country is supposed to run on the ballot not the bullet but after President Obama won by such a large margin it seems those in the small group who did not want him to win are willing to flirt with the former.

All of the "OH MY GOD A GUN!!!" people, just don't get it. The reason why they can run there mouth and voice there opinion, even with out knowing what there basic rights are (pssst----it's called the constitution), you should try reading it befor you run off at the mouth. And know the absolute fact, those guns in the hands of our citizens are the reason why, to this day, you can spout your uneducated opinions about something you don't have the first clue about. Such as the 2nd amendment in the constitution. If you don't belive it, then shut up! It also spells out your right to free speech!!! Among many other rights granted by GOD! Not granted by the government.

Excellent point by point disputation of what I'll refer to as fringe ideas. The whole point of the article should be that the guy broke NO laws and as such was NOT arrested.

In this instance it was our esteemed press that went whacko calling for this guy to be nothing short of castrated. I thought the press' job was to report and not actually make the news on the fly.

I'm willing to bet the Secret Service was, as usual, being rather vigilant and did not perceive this guy as an overt threat -- especially since he did not go out of his way to hide his legally carried firearm.

If the guy wanted to make a point he could have just as easily put a broom stick in an old rifle bag & slung that over his shoulder. That would have made his point without bringing the hardware.

"It is time to water the tree of liberty" could just as easily be interpreted as metaphorically saying that liberty, unless you always nurture it, will wither away. Remember how patriots are often saying "Freedom isn't free"? If you don't regularly exercise your rights as a citizen to speak to your elected representatives about laws you dislike; if you don't vote out representatives who help to pass bad laws; if you don't stand up for others whose rights are violated by police, then freedom starts to die.

Freedom needs constant attention, just as any tree that needs to be watered. Note that he explicitly did *not* include the part about "blood of tyrants".

Besides, if guns are so awful and dangerous and cause such fear, why do we allow police and soldiers to have them? If the majority of people are "good", then allowing them to have guns is a good thing because they'll outnumber the bad people. If the majority of people are "bad", we have no hope anyway.

I have always known that those (regular folks) who vote republican were dumb, because they vote against their own futures. But, I never imagined they were this dumb.

Recent months have exposed these people for what they are, mindless followers.

No sane person would argue that it is OK for someone to pack a gun to a presidential event. I don't care if it's against the law or not, it's nuts!

This moron is lucky the secret service didn't blow his brains out.

So, here we are. In six short months these 'slow-breathers' have gone from 'Obama is a terrorist, to Obama is a communist, to Obama is a socialist, to Obama is a fascist, to Obama is not an American citizen, to Obama wants to kill my grandma, to packing guns!!

A couple of months ago I thought it might be time to start selling tin-foil hats, now I think it's time to bring out the nets.

Yes... Republicans are so stupid, and always have been. Did you know that back in the 1860's they voted in some lame-brain named Lincoln who sent troops to invade the Southern States to keep the United States together as one country and brought an end to slavery in the U.S.? Later, this same inept bunch of politicians pushed civil rights laws in those same states.

Think how easy life could have been if the Democrats had won that election, or at least the war. We could have been two separate countries with two separate constitutions from Canada to the Gulf of Mexico and from the Eastern Seaboard all the way to Texas.

Of course, Mexico, supported by the British at the time, would have retained a good portion of the Southwest, and the Oregon/Washington Territory would have remained in British control or merged with Canada later on. Alaska would have actually been part of Russia, Spain would have sold Florida to Britain, hence, reducing the amount of hurricane damage we would have had to deal with since then, and we probably would not have had to deal Hawaii, Haiti, or the Philippine Islands since they, along with Baja California, would have become German possessions thereby relieving us of the troubles in those areas. In fact, we might have avoided the entire issue of fighting Spain over Cuba (Germany again) or fighting both Germany and Japan in WWII because neither of the two countries formed from the United States after the Civil War would have been strong enough to take on the Axis-Powers or assist England. Of course, slavery would probably have ended much later than it did, but on the upside we would not be dealing with the whole Arab-Israeli issue because Hitler would have completely ELIMINATED the need for Isreal. But then, on the downside, Hitler would have finally come for us, as was his plan.

THANK GOD FOR LINCOLN AND THOSE STUPID REPUBLICANS.

People need to use common sense when exercising their rights. This guy has, or appears to have, little common sense, and has the despicable mindset of the defiant law-hating anarchist, of which there are many in New Hampshire and on the fringes of Society everywhere.

These people are powder kegs and their anti-social behavior needs to be confronted by decent, law-abiding people who don't go around threatening the president with a sign talking about "watering the tree of liberty" [with the blood of tyrants] while packing heat.

Actually, this guy is not a nut job. He stayed away from the hall where the meeting was, never once drew his weapon, stayed on private property, and did nothing more than exercise a right provided to him by the Constitution. Of course, he could have left the gun at home and gone to the meeting, where he could have voiced his opinions regarding certain issues in front of the President and the news media, thereby (through a lack of common sense) exercising yet another Constitutional right.
As for the sign, derived from a quote by Thomas Jefferson, I am sure Jefferson was a nut-job too, having defied the King as he did. But if he and other nut-jobs like him had not, you and I might never have had this moment to share our thoughts. Of course, in the future we can always get rid of the 1st and the 2nd Amendments I guess.

Let a Democrat answer that. It is coming, mark my word. I DO NOT trust this administration any more than the previous one, or the one before that, or the one before that. They are ALL CORPORATE puppets. When enough people wake up and open their eyes to what is REALLY going on, there will be riots in the streets from BOTH SIDES OF THE AISLE. This is not a Republican "thing" or a right wing "thing" there are Democrats out there who are just as angry and just as fed up with the "politics as usual" in washington. So quit trying to make this a ONE SIDED issue, because it is NOT.

I don't mind letting citizens own guns, but when it accompanies signs with references to shedding blood and any politician, that's where my patience grows thin. Can't we have more than one variable to determine gun control? I.e., if you are not a cop within 1000 ft of a politician (or whatever), it is illegal to carry a gun.

Being passively threatening is ignorant and dangerous. Why don't conservatives ever show us that they are mature enough to carry guns (or have a point)?

Owning a gun isn't a constitutional right. You nutcases are always distorting the constitution to fit your extremist agenda. The constitutions reference to the states rights to keep a milita has nothing to do with citizens having a individual right to own a firearm. Owning a firearm is a PRIVILEGE not a RIGHT...........and privileges, as you may know, can be regulated by the state and even taken away.................

Here it is...

Second Amendment: A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Don't confuse militia as anything other than the citizens of a given state. The founding fathers didn't just distrust a large federal government, they distructed any government that could raise an army against the citizens to threaten their liberties, including those of their own states. Besides, as with the majority of our laws, they are based on English Common Law like that below.

English Bill of Rights: That the subjects which are protestants may have arms for their defence suitable to their conditions and as allowed by law (1689).

Stop and open your eyes and LOOK at what this administration is doing, really look. Then ask yourself, what would I think if this was a Republican administration trying to push this bill through in such haste?
