Senators Debate Sotomayor And The Word "Racist"

Senator Jon Kyl, R-Ariz., would not say whether the use of the word "racist" by some Republicans to describe Sonia Sotomayor, based on an 8-year-old comment by President Obama's Supreme Court nominee, was or was not fair, when asked by host Bob Schieffer on Face The Nation Sunday.

"Bob, I am not going to get drawn into characterizations before I have even met her," he said, noting that the Judiciary Committee (of which he is a member) will meet with the judge on Capitol Hill Tuesday.

Republicans have argued that a statement made by Sotomayor in 2001 may indicate that she will inject personal opinion into her rulings.

At Berkley, the judge said, "I would hope that a Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

Senator Dianne Feinstein, D-Calif., who is also on the Judiciary Committee, said she thinks the word racist in this nomination is "an absolutely terrible thing to throw around.

"This does not add any light to the debate, it only adds a kind of visceral and terrible heat," she argued.

Kyl said that the real issue raised by the statement is, "What is her judicial philosophy?

"Or does she believe that she can apply her own views, empathy for one party or another … regardless of what the law is?" Kyl asked.

Feinstein argued that the one problematic word in Sotomayor's statement is "better" — but admitted that she understands what she meant by her statement.

"You could say that the use of that word was inartful, but I think you have to look at the individual in respect to their context."

Bob Schieffer broke down the Republican argument that if the comment were reversed, someone would be in "in a heap of trouble."

Feinstein didn't bite, saying he heard Sotomayor's remark in the context of how she rose to her position against terrible odds. "We women have had to fight for everything we have gotten in the public arena," she said. "I'd say that one statement, probably made with a sense of a smile, you know, 'Here I am, I can do better,' I don't have a problem with it.

"It's not the right thing," Feinstein added, "but I don't think she meant it that way, either."

Kyl on the other hand said she will definitely have to assure members of the Judiciary Committee that she will live by the oath of the Supreme Court.

The Republican Senator took out a piece of paper and read the oath which reads, "'I will administer justice without respect to persons and do equal right to the poor and to the rich.'"

Kyl said that oath means that she will have "not bring in her empathy for the poor person, for example. If the law is on the side of the rich person, then she has to rule in favor of the rich person. If she will do that, then I think she'll have no trouble in her confirmation hearing."

    Why does she hate americans based on skin color that is so racist .Sad.What country is this?

    The country that minorities have had to endure our whole lives. Racism has been a way of life in America. Whites have enjoyed and prospered from skin color forever. Just like their KKK counterparts, they won't admit it without their sheets because they are a bunch of cowards. Most won't admit that they are racists, they just do it in subtle ways.

    It's funny that the race of people who have created racism and based this country on it toward anyone and everyone who is not white. This country's justice system has never been equal. Why? Because we have had a bunch of racists white men who had nothing on their agenda but to continue their silent, silent racism. Now they are afraid that justice may just truly become equal. And maybe their whiteness won't get them everything any longer.

    I am so sick and tired of this when Republicans are in they get to choose when Democrats are in they get to choose.

    Now does anyone truly believe that the Republcians will stop this I mean come on they are making noise.

    What I can't understand is with all the problems we have in this country why they are making noise and not helping to fix the problems.

    Unless they feel as though they have the answer. To that they lost the last 2 elections and they need to be humble if they want to be taken seriosly.

    While i don't think you're saying that republicans are a "culture", it seems appropriate that they are. However, the only "race" they represent is To The Bottom.

    I have heard Republican's say things like "the Party needs to expand and be more inclusive and not just be seen as a Party of old gray hair White men in suits." But I guess it's not considered racist if a culture refers to itself in that manner, its only considered racist if another culture does it!

    Affirmative action -- the illegal, unconstitutional, collective punishment of white males without the right to a trial by jury or the right to confront your accusers.

    Affirmative Action is a hard program to defend, if everyone acted like good Americans and implemented fair play Affirmative Action wouldn't be necessary. But that's like saying if everyone behaved we wouldn't need Police. At its core Affirmative Action is about fair play, achieving balance and diversity based on a pool of participants and even that definition is not perfect, but its the main idea. Affirmative Action is not against any culture, in some cases Whites have benefited from Affirmative Action. Recently White Males were the beneficiaries of Affirmative Action. In many of the nations colleges females are scoring higher on entrance exams and being admitted at a higher rate than males. As a result colleges with imbalances of as much as 70% female to 30% male have implemented Affirmative Action to restore the balance between male and females. Males scoring lower on entrance exams are being admitted to colleges over females who scored higher to achieve a male female balance. White males are not complaining about Affirmative Action in these cases! LOL

    Mitch McConnell says he's not handling the "speech police" over the Limbaugh's calling Sotomayor a racist!

    Mitch McConnell joined John King of CNN to discuss judge Sonia Sotomayor's nomination. King asked him to comment on Limbaugh's racist rant against her. McConnell took the cowardly way out by not denouncing Limbaugh-Gordon Liddy and all the rest of them for their hate speech and instead used a different tactic.

    RUSH LIMBAUGH: So, here you have a racist. You might want to soften that and you might want to say a reverse racist. And the libs, of course, say that minorities cannot be racists because they don't have the power to implement their racism. Well, those days are gone, because reverse racists certainly do have the power to implement their power. Obama is the greatest living example of a reverse racist, and now he's appointed one.

    MCCONNELL: Look. I've got a big job to do, dealing with 40 Senate Republicans and trying to advance the nation's agenda. I've got better things to do than be the speech police over people who are going to have their views about a very important appointment, which is an appointment to the United States Supreme Court.

    So I'm not going to get into policing everybody's speech. The important thing here is to look at the nominee, her qualifications, read the 3,600 cases, and do it right. That's what the American people expect of us.

    In other words, McConnell is whispering, "hey Rush/Newt/Cheney/Buchanan/Tancredo! Keep saying what you're saying and I'll make believe that the Senate Republicans are above it all."

    Asked if Sotomayor is a "racist," Sen. Jon Kyl (R-AZ) ducked the issue on CBS this morning. "I'm not going to get involved in characterizations before I've even met her," Kyl said.

    -Isn't it amazing that they can take an 8-year old, half statement predicated on the word "better" and use that as proof that Sonia Sotomayor is a "racist" despite the majority of her ruling proving otherwise?

    And, at the same time refuse to comment on their own self appointed leaders (Rush's and Newt's) racist rants.

    That's the type of gutter (Rovian) politics that has torpedoed the Republican party - couldn't have happened to a sorrier bunch.

    I think if the media would specify the "conclusion" to WHAT Sotomayor is referring to, it would clear up a lot of speculation.

    How does,As a white male,Who has suffered bitter rejections,owing to affirmative action,quotas,special grants,and other benefits,not afforded me,despite all
    my academic struggles,who has been subjected to the
    most cruel,covert reparation,techniques,It is my opinion,
    that I would make a far better Judge,than any minority
    individual,who has not experienced that life of pain and
    frustration! Yes I know how that will/would be received
    in todays,feminist,and minorities agenda,by the way I am
    not a member of a white supremacist group,Or any group
    that would be considered the match,for "La Raza"!

    Republicans would not tolerate a non-White Limbaugh talking like that on the airwaves, Imus was shut down and taken off the air for much less than Rush Limbaugh gets away with. Limbaugh is the "White" Farrakan minus the Religion.

    Is she the BEST candidate for the job---probably not.

    But, I submit NO president EVER goes with the person believed to be the best---because that person holds NO sense of obligation to the president that nominates him/her!

    So, the real question is: is she sufficient to do the job?
    The answer: more than sufficient! In fact, she's a far superior nomination than any republican president(s) nominated as of late!

    Therefore, objections to her are specious. The GOP continues to try to obstruct, devolve, and destroy American government---the public knows this!

    Let the GOP---and it's leaders---continue to rave on---so there's no doubt in the public's mind---that they ARE, irresponsible madmen!

    Let the Republicans call her a Racist.

    The American Sheeple are not as stupid and easily manipulated as they were before the NeoCon Nightmare.

    They will look at her record, accomplishments, past decisions and come to the conclusion that she is for average working people, and not just another rubber stamp for Corporate Empire.

    So GOP, go ahead and attack her all you want. Get Rush and War Criminal Cheney to carry your banner. YOu wll continue to slide into oblivion - a party of the remaining mindless sloganeers. The trickle-down economy believers. The fearful warmongers.

    Then we can go after all those sleazy corporate-owned Democrats. Eventually we can get our country back.
