Judge: Michigan Primary Law Unconstitutional

A federal judge today ruled that the Michigan law establishing the state's Jan. 15 presidential primary is unconstitutional. The reason? The law unfairly prevents minor parties from access to voter lists.

Because Michigan held its primary before Democratic National Committee rules permitted, the DNC stripped the state of its delegates to the party convention. The candidates boycotted the state, and Obama's name did not appear on the primary ballot.

The Hillary Clinton campaign seized on the decision to urge the Barack Obama campaign to support a new, party-run primary, the results of which would ostensibly replace the Jan. 15 primary results.

"Michigan voters must not be disenfranchised and the Obama campaign must not continue to block Michigan’s efforts to hold a new vote," Clinton campaign manager Maggie Williams said in the statement. "Rather it should move quickly to announce its support for a party run primary."

As CBS News chief political consultant Marc Ambinder notes, the ruling does not mean that a new primary must be held – the judge left that question up to the parties themselves.

"...the ruling today means nothing more than a chance for her to make the case again for a re-vote," Ambinder writes.

The Clinton campaign has been pressing for a revote in the hope that delegates from Michigan (as well as Florida, a state similarly penalized) would help her close the delegate gap on Obama. In the latest CBS News delegate count, Obama leads Clinton 1618 to 1491.

Please stop the hypocrisy, Clinton camp! DNC set the calendar and all the candidates signed pledges to abide by those rules. The leadership (for lack of a better word) of MI and FL chose to break the rules and therefore are subject to the penalties.

HRC said on 10/10/07 on New Hampshire Public Radio%u2019s show, %u201CThe Exchange:
NHPR: "So, if you value the DNC calendar, why not just pull out of Michigan? Why not just say, Hey Michigan, I''m off the ballot?"

"It''s clear, this election they''re having is not going to count for anything," Clinton said.

Top Clinton campaign advisor Harold ICKES:
As a DNC Rules and Bylaws Committee member, he voted last year to strip the two states of their delegates as punishment for moving their primaries up too early, "to prevent the gaming of the system."
Now he supports seating the delegates. "When I voted on the Rules and Bylaws Committee, I did that as a member of the Rules and Bylaws Committee, not as a member of the Hillary Clinton campaign."

Clinton campaign advisor Terry McCAULIFFE argues for seating the FL and MI delegates. But in 2004, as head of the DNC, when MI threatened to hold an early vote he said, "Move your primary too early, and Michigan will lose half its delegates to the 2004 Democratic convention. The closest they''ll get to Boston will be watching it on television," he vowed. "I will not let you break this entire nominating process for one state. The rules are the rules."

So, the rules are the rules. No to MI and FL.

Please ask the Obama campaign why they are blocking a new primary as approved by the DNC. Obama''s initial objection was that Republicans could not vote, but after the DNC said they would allow that, the Obama campaign still said no. How can they continue to oppose allowing people to vote? Doesn''t sound very democratic to me?

Neither Clinton nor Obama can claim a mandate if Florida and Michigan delegates are not seated with voting rights.
Looks like Dems are shooting themselves in the feet insuring the next President a lame duck four year term. But who Cares? We don''t need no stinking President.

Who is losing in a "big way"?? There has never been one closer than this year. I want Hillary to stay in all the way to the convention...unless the superdelegates decide to end it before then and vote on who is more electable...which goes without saying that it''s her. He comes nowhere near being free to pass a GOP swiftboat against McCain. They will tear him apart...he will lucky to keep his Senate seat next election when they are done. It''s probably best anyway, because I sure would hate to see someone get the nomination that doesn''t believe that every vote counts. Millions of voters, just you and I, will be building up all that anger until the General Election. I know I would be. If BO ever really thought he had a chance and that the MAJORITY of the populace really did like him better, then the revote would not be an issue. Seems to me that he is alittle scared of the results, so to heck with two of the largest states...you know, the ones that won''t be supporting him the general election in Nov. 08. We the people of Florida and Michigan have cast our votes. The Clinton campaign agrees that our votes should count. The Obama campaign wants to disregard how we voted and start over. He was on the ballot in Florida and told his supporters in Michigan to vote "Uncomitted". It''s clear to me and most of the people I know. We voted, we chose Hillary Clinton overwhelmingly 50% to 33% in Florida. In Michigan Hillary Clinton received 55% and "Uncomitted" received 40%. The 40% should be split between Obama and Edwards since they both told their supporters to vote "Uncommitted". It seems to me Obama will play fair only when he wins!!

That it will be obvious to even you that he is just not electable? We are going all the way to Denver unless the DNC pulls some power move for you. The concept of one person, one vote and everyone gets a say in our country through the votes of its citizens is being sullied by the party that has long been hearlded as the civil rights party. The voters of MI and FL are being discriminated against by the DNC. Regardless of who won, the votes should be counted. The state held the primary, which makes it a state sanctioned election. All votes should count.

From Obama campaign: As we%u2019ve said consistently, we think there should be a fair seating of the Michigan delegates. The Clinton campaign has stubbornly said they see no need to negotiate, but we believe that their Washington, my-way-or-the-highway approach is something voters are tired of.

Actually Obama wouldn''t negotiate re-votes in Florida and Michigan for the simple reason, that if there was a re-vote, the DNC may not allow him to have the votes and delegates because he broke the DNC rules in Michigan by holding press conferences urging the voters to vote uncommitted, and because he held press conferences in Florida and ran ad campaigns there.

THAT is why he won''t back the re-votes!

Obama doesn''t even want to TALK about the Michigan vote. His name was not on the ballot, and he urged voters to vote uncommitted. Yet the voters came out and supported Hillary 328,000 votes to McCain''s 257,000 votes! Which shows the voters will back Hillary and has the possibility of beating McCain. And the DNC is not real sure that Obama can beat him.

That''s why Hillary is still a viable candidate. The DNC has to wait until ALL the votes are in, because they have to take in statistics on the popular vote because of the November election.

I know you said that MI and FL wouldn''t count, and I know that everyone agreed to it, but no one expected to get into this mess, did they!
But here we are, in a race so tight that we need the voters of MI and FL to help get us to a legitimate winner.
Is it worth stubbornly sticking to your guns if it means that the people of MI and FL (and many in other states, too) are so angry at their being disenfranchised that they stay home or vote for Nader or Senator McCain?
Find a way to legitimately count those votes (which does NOT mean giving your Chosen One delegates that he did not earn) or you will find a desertion from the party come November.
Is sticking to your guns really worth that??

Of course Obama does not want Michigan or Florida to vote. He is afraid of what is forthcoming; Hillary will win both states again. However, if neither of these states are allowed to vote this will be viewed by Hillary''s supporters that Obama has stolen the election. Just as it was stole from Al Gore in 2000.

If Obama gets the nomination; this Hillary supporter and his family will vote for McCain.

I have always voted democrat but I will not vote in November if Hillary is not the top of the ticket. In fact I hope it will be clear enough to the Super Deligates that Obama can only hurt the ticket so that they do not try to put him in as Hillary''s VP. As for Hillary I hope she would not take the VP slot under the racist Obama because it would hurt her and she would be better off to run again in 2012 after McCain beats Obama.

Obama is not going to agree with Hillary that Michigan and Florida be allowed to vote again. He is afraid he will loose for the second time. However, if these states are not allowed to vote before the convention; Hillary''s supporters will view it as a stolen election.

This Hillary supporter and his family will vote for McCain.

Lets put the blame where it belongs; the DNC.

To the Obama Campaign: a negotiation is not when you tell the other candidate you''ll split the votes 50/50 before your candidate has even earned them. Having TV ads is still campaigning and he broke the rules and lost in Florida he removed his name by choice and Hillary again beat him. The negotiation should be should the vote be counted as it was last cast or should we have a re-vote? Are you Chicken?? That doesn''t sound like a UNIFIER it sounds more like splitting what unity is left.

Have any of you even stopped to think about this so-called disenfranchisement? Michigan and Florida KNEW of the DNC penalty for line-jumping, but they went ahead anyway. NOW MI and FL scream about civil rights and due-proces for voters. Why didn''t anyone think of these issues before?

Answer: Because they believed they could strong-arm Dean and the DNC into compliance. They also believed Hillary would win BIG and EARLY -- they wanted to be able to say that they helped to put her in the Oval Office. Neither scenario has worked so far -- and it shouldn''t.

It is sad that the votes won''t count, but this is NOT Dean''s or the DNC''s fault. The blame rests with the states. If a group of people were in line for, say, concert tickets and management placed a sign that said "Line-jumpers will not receive service" would we blame management for refusing service to the violators? This is no different.

It isn''t the fault of the voters in the states of Michigan and Florida that the state parties made a decision that ruined the democratic process for Americans. There should be a re-vote or a seating as the votes currently stand. Voting is a right of the American people, All Americans. My opinion is that Obama and his camp needs to get off their high horse and do whats fair of the voters in Michigan and Florida, because if the tide was turned im sure he would not be as free to give the other camp 50% if he was on the top in the those races, so I say give the Hillary what is deserved her and Obama quit being a sore loser.

Didn''t BHO behave in a similar fashion to get elected to the Illinois Senate? Basically he challenged the signature petitions of everyone in the race. He ran unopposed by the time all was said and done! If he will go that far for a seat in a state legislature, look out. There is no limit to the lengths he might go to for the highest office in the land!

Be careful when you wish for the Democratic Party to step in and make a decision about this - they are already discussing nominating a candidate different then the remaining 2 running. Leave it to the wise people in the party to find the perfect solution to not having Florida or Michigans votes count - don''t have any of the votes count and nominate whoever you want! Can you believe in an election year where the Democrats should waltz to the Whitehouse they have found a way to screw it up again - what a bunch of incompetants!

Unfortunately for Hillary--she can''''''''t catch a break, soon to potentially break in the news is the story before the California appeals court which could DeLay her candidacy for good. this time evidence shows that Hillary (HERSELF ONCE AGAIN)was involved. At issue is a 250K donation made to her senatorial campaign. Her staff said she had no knowledge of it, so she was not roped into the scandal when her campaign mgr faced charges of hiding that money from the IRS.

Unfortunately VIDEO may again place Hill in deep doo, doo. It seems there is a video tape recording her discussing the fund raiser with the donors (on it, she talks about who would be there and what they will do) this means she performed what is known as a direct campaign request. donations from donors for that kind of request are limited to 25K. Since the donation was for 250K, that would be considered campaign fraud.

Woe is Hillary and Damnnnn those videos and tape recordings that make being a great liar so hard to keep up these days!!! ROTFLMAO.

Splitting the Florida and Michigan votes 50/50 is a ridiculous solution. You might as well not even count them if that is the only option. That split completely discounts what those voters intended. In a race this close, we need to count every single vote before we can come to any sort of fair resolution.

In a January speech at the University of South Carolina, First Lady aspirant Michelle Obama made remarks making the rounds on the internet today.

Talking about her experience at Princeton where she hung with a largely African-American crowd, she said, "We don%u2019t like being pushed outside of our comfort zones. Michigan and Florida voters should be heard. They may go for Clinton (again) or Obama (this time) or Mickey Mouse (at this point). However they vote, they should be heard. The state officials tried to hold an early vote, and they were sanctioned in that their early vote counts have been discounted. Fine, throw out the unsanctioned voting, but the voters should be heard.

The best option for democrats this year doesn''t believe the typical white woman is a scared racist and hasn''t sat in a pew for twenty years listening / not listening / selectively listening to vitrolic racist comments from a "mentor."

The best option has the experience, knowledge and ability to get the hard job ahead done--and actually shows up to meetings and makes the tough calls the job requires.

After 8 years of an incompetent outsider, we are hopelessly embroiled in another Vietnam-like conflict and our economy is in the toilet bowl with our enemies having fun flushing the bowl.

The last thing we need is another incompetent outsider making even a bigger mess of things. McCain would be a better choice for democrats than that!

leedoria: Did you hear what the judge said? The original vote was unconstitutional - you can''t seat as per the vote when it is unconstitutional and under the conditions Obama would be awarded no delegates because his name wasn''t even on the ballot. Before the primary was run the candidates and the voters were told - these results will not count. That information effected the choices of the candidates and the voting behavior of the voters - it is that simple. The easiest and cheapest way to sit the delegates is to split them. That way they get to participate.

It''s clear from your comments who you are supporting for president. It''s also clear that should she not secure the Democrtaic nomination that you believe the rival Republican is more worthy of your vote than the only individual who really makes sense. It''s your vote, so it''s yours to waste as you see fit. First, Geraldine Ferraro (1984) and now Lil'' Hillary (2008). Same ***, same results.

Obama could have left his name on the ballot, but opted not to. Instead, he participated in influencing the "none of the above" option believing it would embarrass Hillary and play to his favor later on. The plan backfired. It''s time for the lawyers to jump on the bandwagon and recognize that because Obama did not just remove his name, but then influenced the none of the above option; that he influenced that primary ticket. Therefore, the votes should count. Obama''s percentage of the none of the above votes should be apportioned by percentage based on where everybody was going into Michigan. Hillary is the only candidate who has consistently stood up for the people in all states. She is truly a leader for all of the people all of the time, not just some of the time! Hang in there Hillary, and anyone and everyone out there with power to make the MI and FL votes count need to enforce Obama''s manipulation of the none of the above voting option and count that as his share of the votes.
