DALLAS (CBSDFW.COM) - There is a new development in the police officer involved shooting in Grapevine. Lawyers for the victim say a new witness has come forward.

Ruben Garcia Villalpondo was shot and killed by a Grapevine police officer on February 20. Police say the officer was responding to a burglary alarm.

After a pursuit that ended in Euless, police say Garcia refused to follow the officer's commands.

Family members and attorney Domingo Garcia have seen dash cam video of the incident and say the officer used unnecessary violence.

A female witness who passed the scene after the shooting explained what she saw that night at a press conference Thursday morning. She said she saw Villalpondo's body on the side of the road, not on the road. There was no police backup, no lights or police standing by the scene until more people arrived.

Police have not released the dash cam video.

Grapevine police have asked the public to reserve judgment until the investigation is complete.
