DALLAS (1080 KRLD) - It looks like the city of Dallas may be able to keep an adult expo out of the Kay Bailey Hutcheson Convention Center.

In a 32-page opinion, Federal Judge Sydney Fitzwater has refused to issue a preliminary injunction that would have forced the City to lease the Convention Center to the promoters of the Exxxotica Adult Expo.

During a hearing earlier this week the city showed videos demonstrating lewd behavior on the main stage last year. That was enough for Judge Fitzwater.

The promoters filed a lawsuit and said it was a right under the first amendment. But attorney Thomas Brandt, who represented the City, says it's the city's right.

The promoter has the right to appeal but Brandt says it's unlikely that will be heard and ruled on by Friday.

The promoter said it would be impossible to hold the show in May if the contracts are not signed by the end of this week.
