Pet Prenups Could Save Divorcing Couples Grief

DALLAS (CBSDFW.COM) - Should couples sign a pet prenup? Divorces are never easy. And, it's complicated when you get pets involved.

Former Judge Marilea Lewis handles family law cases for the law firm Goodwin Lewis in Dallas.

She says handling pet custody issues are challenging. "In many situation pets are the only children a couple has," Ms. Lewis told CBS 11 News.

Texas law defines pets as property. " They are not considered as living beings like children. But we know they are living, breathing, sentient beings. Ms. Lewis said.

Therefore many pet owners are considering pet prenups. And it's not just for dogs and cats. But also for farm animals.

Without a prenup - the animal will most likely end up being with whoever bought it or whoever paid for most of the services.

Ms. Lewis said in her time on the bench- one couple came up with a creative arrangement for their hunting dog.

"The parties were able to reach a visitation schedule that primarily dealt with hunting season," Lewis said.

"During hunting season, the dog was with the hunter and non-hunting season, the dog was just a companion dog."

Her advice- whether you're married or not, it is always wise to draw up a contract that deals with pet custody issues.

Having a prenup involving pets can save you a lot of grief, should you separate.
