THE COLONY (CBSDFW.COM) - A Denton County grand jury decided not to indict an accused drunk driver involved in a deadly crash with intoxication manslaughter.

Now the Denton County District Attorney plans to file lesser charges.

The Colony Police say the driver ran a red light and hit and killed Jeremy and Stephanie Byington while they were riding their motorcycle on April 5.

Police say the DA will pursue a DWI charge instead.

Police say the driver's name will be released once a warrant is executed and he is arrested.
