District Judge Tosses Open Carry Lawsuit Against City Of Arlington
ARLINGTON, Texas (1080 KRLD) - U.S. District Judge Reed O'Connor has tossed the lawsuit by Open Carry Tarrant County against the city of Arlington.
This comes from an incident last year where people carrying rifles and shotguns were handing out copies of the Constitution at intersections around the city of Arlington.
The city said it was against an ordinance that involves safety. The Open Carry advocates said it was limiting their rights.
The city amended its ordinance and the court had barred enforcement until this ruling.
Now the lawsuit has been dismissed and the order barring enforcement has been lifted.
Arlington city attorney Robert Fugate says because the city has never enforced the amended ordinance, it's too early for a lawsuit. Fugate says the Arlington city council will decide what its next step is at a later meeting.
Open Carry Tarrant County has the right to refile a different complaint if it wants to challenge the new ordinance.
