ADDISON (CBSDFW.COM) - Addison police have withdrawn a capital murder warrant issued for Luz Aurora Granados-Reyes after the Collin County Medical Examiner said he can't prove her baby was alive when it was delivered in a hotel bathroom.

The Dallas County Sheriff's office was notified that the arrest warrant was recalled and Ms. Granados-Reyes can be released.

Following an autopsy the Collin County Medical Examiner stated that there isn't sufficient evidence to prove the child was ever alive.

A representative of the Dallas County District Attorney's office has determined that based on the medical examiner's report there isn't a valid charge that can be filed in the case at this time.

The Medical Examiner said that certain microscopic data will be looked at by a specialist, and some toxicology tests will be done; however, he believes the chance of anything causing him to revise his opinion is very remote.
