NightSide - Is UC-Berkeley Skirting The Law?

BOSTON (CBS) - The University of California – Berkeley is pioneering a new program called the African-American Initiative. The school calls the program, "a comprehensive effort to address the underrepresentation of African American students, faculty, and staff at our university, and improve the climate for those who are here now and all who will join our community in the future." But some say the program violates Prop 209, a law that makes it illegal to consider sex, race, or ethnicity in public employment or education. Ward Connerly, an African-American who served on the UC Board of Regents from 1993-2005, believes the new program is a way for the school to get around the law. He joins NightSide to explain his concerns with the new initiative.
